THIS INDENTURE, made the �_Jday of October, nineteen hundred and ninety-eight BETWEEN CARLOS DeJESUS, residing at 413 Sixth Street, Greenport, New York 11944 party of the first part, and 1(0J 5 MERCEDES ALVAREZ, residing at 414 Sixth Street, Greenport, New York 11944 party of the second part, IOD WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected, 100 situate, lying and being in the Village of Greenport, Town of Southold, County of Suffolk and State of New York, bounded and described as follows:- BEGINNING at a point in the easterly line of Sixth Street, 198.14 feet northerly of the intersection of the northerly line of Flint Street and said easterly line of Sixth Street; THENCE along the said easterly line of Sixth Street, North 07 degrees 18 minutes 40 seconds ^ � East, 25.73 feet; THENCE North 84 degrees 11 minutes 40 seconds East, 170.56 feet; THENCE South 07 degrees 18 minutes 20 seconds West, 67.15 feet to a concrete monument; THENCE North 81 degrees 45 minutes 00 seconds West, 166.14 feet to the easterly side of Sixth Street at the point or place of BEGINNING. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed from Carlos DeJesus as administrator of the Estate of Benigno DeJesus, deceased 6/15/78, dated 6/15/81 and recorded in the Suffolk County Clerk's Office on 8/20/84 in Liber 9624 cp 347. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER 11925PE180 with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
