WITNESSETH, that the party of the first part, in COnsideration of TEN and no/100ths ($10.00) dollars paid by
the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the Village of Greenport, Town of Southold, County of Suffolk and State of New York,
bounded as part of the premises conveyed by Nathaniel Corwin, Sidney L. Griffin and J. Wickham Case,
Commissioners in Partition to Jonas Smith, by deed dated 6/14/1853 and recorded in the Office of the Clerk of
Suffolk County on June 15, 1853 which on a certain Map of Wiggins Estate, duly dated 5/19/1853, signed by
the said Commissioners and filed in said Clerk's Office is designated as follows; Lot No. 59, bounded and
described as follows:
BEGINNING at the comer formed by the intersection of the East side of Fifth Street and the South side of
Wiggins Street;
RUNNING THENCE South 88 degrees 21 minutes 20 seCOnds East along the South Side of Wiggins Street,
166.65 feet to an iron pipe and land of the Commissioner of Welfare;
THENCE RUNNING South 6 degrees 56 minutes 00 seCOnds West, along the last-mentioned land, 67 feet to
an iron pipe and land of Joseph Lupshewitz;
THENCE RUNNING North 82 degrees 30 minutes 10 seconds West along last mentioned land, 165.91 feet I~o
an iron pipe and the East side of Fifth Street;
THENCE RUNNING along the East side of Fifth Street, North 6 degrees 55 minutes 00 seconds East, 50 feet
to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the parties of the first part by deed from Paul
J. McCarthy and Linda A. McCarthy, his wife dated 9/23/75 and recorded in the Suffolk County Clerk's Office
on 9126/75 in Liber 7913 cp 93.
TOGETHER with all dght, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND .TO HOLD the
~remises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in COmpliance with Section 13 of the Lien Law, COvenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the COst of the improvement and will apply the same
first to the payment of the COst of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be COnstrued as if it read "parties" whenever the sense of this indenture so
requires.
