JOHN P. DIETZEL, ns Trustee of the JOHN P. DIETZEL LIVING TRUST AGREEMENT
DATED APRIL 11, 1997, residing at 1675 Pine Neck Road, Southold, NY, 11971, as to an undivided
fifty (50%) percent interest and
DOROTHY A. DIETZEL, as Trustee of the DOROTHY A. D1ETZEL LIVING TRUST
AGREEMENT DATED APRIL 11, 1997, residing at 1675 Pine Neck Road, Southold, NY, 11971, as
to an undivided fifty (50%) percent interest
party of the first part,
JOHN P. DIETZEL AND DAVID J. DIETZEL, as co-Trustees of the JOHN P. DIETZEL LIVING
TRUST AGREEMENT DATED APRIL 11, 1997, residing at 1675 Pine Neck Road, Southold, NY,
11971, ns to an undivided fifty (SO°/g) percent interest and
DOROTHY A. DIETZEL nnd DAVID J. DIETZEL, as co-Trustees of the DOROTHY A.
DIETZEL LIVING TRUST AGREEMENT DATED APRIL 11, 1997, residing at 1675 Pine Neck
Road, Southold, NY, 11971, ns to an undivided fifty (50%) percent interest
party of the second part.
WITNESSETH, that the party of the first part, in consideration ofTEN ($10.00) dollars, laxvful money of
the United States paid by the party of the second part, does hereby grant and release unto the party of the
second pa~ the heirs or successors and assigns oftbe party of the second part forever,
ALL that certain plot. piece or parcel of land, with the buildings and improvements thereon erected,
situate, lyingnnd heingin ~e Villa~ of~kl, Town ofSoulhoid, CouniyofSuffollg and State of New York,
bounded and described ns follows:
BEGINNING at a poim on the northerly side of Pine Neck Road at the division line between Lots 4 and 5
as shown on the Map of Property of C. Wells Phillips as surveyed by F. F. Overton, Surveyor, August 1909
and filed in the Office of the County Clerk on November 6th, 1909 as Map No. 297;
RUNNING THENCE along the said northerly side of Pine Neck Road North 85° 30' 00" West I00 feet to
the division line between Lots 5 and 6 as shown on the aforesaid map;
THENCE along said last mentioned division line North 5° 00' 00" East 487 feet to the ordiuaty high water
mark of Jockey Creek;
THENCE easterly along the said high water mark of Jockey Creek, the tie line of which bears South 78°
37' 40" East 100.21 feet to a point in a line bearing North 4° 57' 10" 'East and distant 475 feet northerly
from the said northerly side of Pine Neck Road when measured along said line and,
THENCE South 4° $7' 10" West 475 feet to the said northerly side of Pine Neck Road at the point or
place of beginning.
BEING AND INTENDED TO BE the same premises conveyed to the grantors herein by deed dated May
17, 1974 recorded in the Office of the Clerk of the County of Suffolk on May 23, 1974 in Liber 7642 page
531.
THIS DEED IS MADE TO CONFIRM DEED DATED APRIL 11, 1997 RECORDED IN THE
OFFICE OF THE CLERK OF THE COUNTY OF SUFFOLK ON APRIL 17, 1997 IN LIBER 118'~6
PAGE 005.
TOGETHER with ail right, title and interest, if any, of the party of the first pa~ in and to uny streets and
roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and fights of the party of the first part in and to
said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second pa~, the heirs or
successors and a~signs of the pafly of the second part forever.
AND the party of the first pan covenants that the party of the first part has not done or suffered anything
whereby the said premises have b~en incumbered in any wa)' whatever, excepl as aforesaid.
AND THE par~y of the first part. in compliance with Scction 13 of thc Lien Law, covenants that the party
of the first part will receive the considcration for this conveyance and will hold the right to receive such
consideration as a trust fund to b~ applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment ofthe cost of the improvement before using any part of the u)~al
o£the same for any other purpose. The word "party" shall b~ construed as if it read "parties" whenever
the sense of this indenture so requires.
