11971, as to an undivided fifty. (50%) percent interest and
DOROTHV A. DIETZEL and DAVID J. DIETZEL, as eo-Trustee~ of the DOROTHY A.
DIETZEL LIVING TRUST AGREEMENT DATED APRIL I I, 1997, residing at 1675 Pine Neck
Road, Southold, NV, 11971, as to an undivided fifty (50%) percent interest

Main Bayview Road, Southold, New York, 11971
party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTEN ($10.00) dollars, lawful money o1'
the United States paid b.v thc party oftbe second part, does hereby grant and release unto thc party of the
second part, the heirs or successors and assigns of the party of the ~.'cond part forcvgr,
BEING AND INTENDED TO BE the same premises conveyed to the grantors herein by confirmation deed
dated Augum 20, 2006 recorded in the Office of thc Clerk of the County of Sufiblk on August 21,2006 in
l.iber 12465 page 416.
TOGETHER with all right, title and interest, if an~;, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines tbereof.
TOGETHER with the appurtenances and all the estate and rights of the party of thc first part iu and to
said premises.
TO HAVE AND TO HOLD the premises herein granted unto the part)' of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that thc party ol'thc first part has not done or sufl~red anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien l.aw, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first ibr the purpose of paying the cost of the improvement, and
will apply the same first to the payment ortho cost of the improvement before using any p',u't of the total
of the same for any other purpose. The word "part)," shall be cofistrued as if it read "parties" whenever
the sense of this indenture so requires.

SCHEDULE
ALL that certain plot, piece or parcel of land, situate, lying and being in the Village of Soulhold, Town of
Southold, County of Suffolk. and State of New York. bounded and described as follows:
BEGINNING at a point on the northerly side of Pine Neck Road at thc division line between Lots 4 and 5
as shown on the Map of lh'operty of C. Wells Phillips as surveyed by F. F. Overton; Surveyor, August
1909 and filcxt in the Office of the County Clerk on November 6th, 1909 as Map No. 297;
RUNNING THENCE along the said northerly side of Pine Neck Road North 85° 30' 00" West 100 feet to
the division line between Lots 5 and 6 as shown on the aforesaid map;'
THENCE along said last mentioned division line North 5° 00' 00" East 487 feet to thc ordinary, high water
mark of Jockey Creek;
THENCE easterly along the said high water mark of Jockey Creek, the tie line of which bears South 78°
37' 40" East 100.21 feet to a point in a line beating North 4~ 57' I 0" East and distant 475 feet northerly
from the said northerly side of Pine Neck Road when measured along hid linc and,
'['i-iENCE South 4° 57' 10" West 475 feet to the said northerly side of Pine Neck Road at the point or
place of beginning.
