Pollert who died on March 25, 2000 a resident of Suffolk County, New York, party of die first part, 7( ' ? and FREDERICK BRUCE POLLERT, residing at 24 Mud Road, Setauket, New York, and WILLIAM RICHARD POLLERT, residing at 574 West End Avenue, New York, New York, as Trustees of the WILLIAM J. POLLERT TESTAMENTARY TRUST, party of the second part, WITNESSETH, that the party of die first part, to whom letters testamentary were issued by the Surrogate's Court, Suffolk County, New York on March 16, 2001, and/or by Article 11 of the Estates, Powers and Trusts Law, without consideration, does hereby grant and release unto the parties of the second part, the heirs or successors and assigns of the party of the second part forever, ALL those certain plots, pieces or parcels of land, with the improvements thereon, if any, situate, lying and being in the Town of Southold, County of Suffolk and State of New York, bounded and described as follows: See Attached Schedule for Description Said premises being known as and by street number 375 Lighthouse Lane, Southold, New York. Said premises being known as District 1000, Section 70.00, Block 06.00, Lot 029.002 on die Suffolk 01~.~ and Tax Map. ~'r~B~h~e~remises conveyed to William J. Pollert by deed dated May 20, 1991 and recorded on The premises are not in an agricultural district and the property described in this deed is the entire parcel owned by the transferor. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "parry" shall be construed as if it read "parties" whenever die sense of this indenture so requires. Gratwohl, which latter point is distant 44.64 feet easterly from a monument on the northerly side of Pine Neck Road; (1) North 8 degrees 55 minutes 40 seconds West, 200 feet to a point; (2) North 78 degrees 04 minutes 20 seconds East, 146 feet to the point or place of BEGINNING; and RUNNING THENCE from said point or place of beginning, North 4 degrees 12 minutes 50 seconds West, through a monument 274 feet more or less to the ordinary mean high water mark of Jockey Creek; THENCE along the ordinary mean high water mark of Jockey Creek in an easterly direction 168 feet more or less to the land now or formerly of Gibbons; THENCE South 1 degree 00 minutes 00 seconds West, along last mentioned land 322 feet more or less to the center line of a right of way; THENCE South 84 degrees 04 minutes 20 seconds West, 14.20 feet; THENCE South 78 degrees 04 minutes 20 seconds West, 115.24 feet; THENCE North 4 degrees 12 minutes 50 seconds West, 15.14 feet to the monument on the northerly side of said right of way, the point or place of BEGINNING.
