consideration paid by the patty of the second part, does hereby grant and release unto the party of
the second pa.n, the heirs or successors and assigns of the party of the second pan forever,
ALL that certain plot, piece or parcel of land. with the buildings and improvements thereon
erected, situate, lying and being at Southold, Town of Southold, County of Suffolk and State of
New York, bounded and described as follows:
BEGINNING at a point on the southerly line of Pine Neck Road 115.00 feet westerly along
said southerly line from Bennets Lane; said point of beginning being the northwesterly corner
of land now or formerly of Hofer and from point of beginning;
RUNNING 'along said last mentioned land South 9 degrees 40 minutes 40 seconds Wc~t,
150.28 feet to Lot 5 as shown on "Map of Fairview Park", filed in the Suffolk County Clerk's
Office as Map No. 3388;
THENCE along said Lot 5, North 83 degrees 47 minutes 10 seconds West~ 104.20 feet to land
now or formerly of LaFreniere:
THENCE along land now or formerly of LaFreniere, North 9 degrees 40 minutes 40 seconds
East, 150.28 feet to said southerly line of Pine Neck Road;
THENCE along said southerly line, South 83 degrees 47 minutes 10 seconds East, 104.20 feet
to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated 12/12/1991, and recorded 12/19/1991, 'in the Office of the Suffolk County Clerk in
Liber 11388, Page 463.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the [many of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the pa~y of the second
part. the heirs or successors and assigns of the party of thc second part forever.
AND the party of the first part covenants that the pa~y of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party oftbe first pari, in compliance with Section 13 of the Lien Law. covenants that
the pal~y of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other pu~ose.
The word "pany" shall be constroed as if it read "parties" whenever the sense of this indentare so
requires.
