RUTKOSKI, his wife, residing at 18275 Main Road, Mattituck, New York ^, TRICT SECTION BLOCK LOT party of the first part, and ! 7 G) I ROBERT RUTKOSKI and MARILYN RUTKOSKI, his wife, residing at 15955 Main Road, Mattituck, New York party of the second part, WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, a fifty (50%) percent interest in ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being iWtft at Mattituck, in the Town of Southold, County of Suffolk and State of New York, being bounded and described as follows: BEGINNING at a concrete monument on the southerly line of Wickham Avenue at the division line of lands n/o/f of Joseph Pollio and Ruth Pollio and land of Henry Rutkoski and Helen Rutkoski; RUNNING THENCE along the southerly line of Wickham Avenue North 63 degrees 28 minutes 17 seconds East, 317.83 feet to a concrete monument; RUNNING THENCE along land n/o/f of Community Christian Fellowship South 36 degrees 37 minutes 40 seconds East, 507.31 feet to the northwesterly line of Middle Road (C.R. 48) ; RUNNING THENCE along the northwesterly line of Middle Road (C.R. 48) the following two (2) courses and distances: 1) along an arc bearing to the left having a radius of 2095.82 feet, a distance of 175.90 feet (also along a chord with a bearing of South 16 degrees 49 minutes 39 seconds West) to a concrete monument; 2) South 14 degrees 25 minutes 23 seconds West 234.71 feet to a point and land n/o/f of Joseph Pollio and Ruth Pollio; RUNNING THENCE along said last mentioned land North 35 degrees 51 minutes 40 seconds West, 815.37 feet to a concrete monument in the southerly line of Wickham Avenue at the point or place of BEGINNING. BEING AND INTENDED TO BE a part of the same premises conveyed to the grantors herein by deed recorded in Liber 5704 cp 452. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO }FOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
