a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
., b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not coinmenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit tbr an
addition six months. Thereafter, a new permit shall be required.

The proposed construction, on this non-conforming 33,667 square ft. lot, in the AC
District, is not permitted pursuant to Article XXIII Section 280-122A which states;
"Nothing in this article shall be deemed to prevent the remodeling, reconstruction
or enlargement of a non-conforming building containing a conforming use,
provided that such action does not create any new non-conformance or increase
the degree of non-conformance with regard to the regulations pertaining to such
buildings."
The single-family dwelling, notes a front yard setback of 36.5'. The additional
construction indicates a front yard setback of approximately 36.5'. Pursuant to
the interpretation in Walz (#5039), such additions and alterations will thus constitute an
increase in the degree of nonconformance. The alteration is not permitted pursuant to
Article XXIII, Section 280-124, which states that non-conforming lots, measuring
between 20,000 & 39,999 square feet, require a minimum front yard setback of 40'.

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property
under consideration in this application and determines that this review falls under
the Type II category of the State's List of Actions, without further steps under
SEQRA.
BASIS OF APPLICATION: Variances under Sections 280'122A, 280-124, and ZBA
Code Interpretation #5039 (Walz Application), based on the Building Inspector's
December 3, 2007 Notice of Disapproval concerning proposed alterations to the
existing dwelling, which new construction constitutes an increase in the degree of
nonconformity with the front yard setback at less than a minimum of 40 feet.
AREA VARIANCE RELIEF REQUESTED: The proposed construction on this non-
conforming 33,667 square foot lot in the Agricultural Conservation Zone District, is
not permitted pursuant to Article XXII, Section 280-122A which states "Nothing is
this article shall be deemed to prevent the remodeling, reconstruction or
enlargement of a non-conforming building containing a conforming use, provided
that such action does not create any new non-conformance or increase the degree of
non'conformance with regard to the regulations pertaining to such buildings."
The June 28, 2004 survey prepared by Joseph A. Ingegno indicates a 36.5 ft. front
yard setback for the existing dwelling. The proposed additional construction
indicates a front yard setback of 36.5 feet as shown on the diagram prepared by
Elizabeth Thomson, Architect. Pursuant to the Code Interpretation #5039 (Walz
Application), such additions and alterations will thus constitute an increase in the
degree of nonconformance under Article XXIII, Section 280-124, and the alteration is
not permitted for the reason that new construction, on nonconforming lots
measuring between 20,000 and 39,999 square feet, require a minimum front yard
setback of 40 feet.

FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this apphcation on February
28, 2008, at which time written and oral evidence were presented. Based upon all
testimony, documentation, personal inspection of the property, and other evidence,
the Zoning Board finds the following facts to be true and relevant:
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:
1. Town Law §267'b(3)(b)(3)(1). Grant of the variance will not produce as
undesirable change in the character of the neighborhood or a detriment to nearby
properties. Lands adjacent to Oregon Road are comprised of farms with homes well
distanced from each other. The area variance requested for the enclosing of the
present entry way is only 44 square feet, and the applicant will be maintaining the
same distance to the tYont yard of 35.6 feet.
2. Town Law §267'b(3)(b)(2). The benefit sought by the applicant cannot be
achieved by some method, feasible for the applicant to pursue, other than an area
variance. Applicants wish to enclose an existing recessed front entry because the
main entry is being relocated to the driveway side of the home. The enclosure of the
existing entry is crucial to the revised floor plan resulting in an alteration of only 44
square feet.
3. Town Law §267'b(3)(b)(3). The variance granted herein is not substantial.
4. Town Law §267'b(3)(b)(5). The difficulty has not been self created. The applicants
found the house in that condition when they purchased it.
5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a
variance in this residential community will a have an adverse impact on the physical
or environmental conditions in the neighborhood.
6. Grant of the requested rehef is the minimum action necessary to enable the
applicant to enjoy the benefit of a new entrance while enlarging their living space in
the home and preserving and protecting the character of the neighborhood and the
health, welfare and safety of the neighborhood.
RESOLUTION OF THE BOARD: In considering all of the above factors and
applying the balancing test under New York Town Law 267'B, motion was offered
by Member Oliva, seconded by Member Simon, to
Grant the variance as applied for, as shown on the 12/15/07 elevation

drawing and 11/16/07 site plan prepared by Elizabeth Thompson.
Any deviation from the variance given such as extensions, or demolitions which are not
shown on the applicant's diagrams or survey site maps, are not authorized under
application when involving nonconformities under the zoning code. This action does not
authorize or condone any current or future use, setback or other feature of the subject
proper~y that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature
for an alteration that does not increase the degree of nonconformiW.

Dear Inspector,
This is to confirm that the new insulation installed at the above residence conforms to the NY State
Energy Conservation Construction Code for residences, as calculated on the REScheck Compliance
Certificate submitted with the building permit application.
In addition, the extra support beams added in the basement to the existing building department
approved structure to reduce deflection, have not been compromised by the holes drilled to
accommodate plumbing.

CARBON MONOXIDE ALARM FACT SHEET AND
CERTIFICATE OF INSTALLATION ~
On June 16, 1999, the Board of Health adopted new standards to the Suffolk County
Sanitary Code for carbon monoxide (CO) alarms. Effective October 1, 1999, CO alarms are
required in all new one4amily dwellings, two-family dwellings and multiple dwellings.
Carbon monoxide alarms installed to satisfy this code must be certified by a
nationally recognized testing laboratory to conform to Underwriters Laboratories Standard
UL 2034. The alarms must also be equipped with a digital readout of CO concentration and a
button to indicate the maximum CO concentration since the feature was last reset.
Carbon monoxide al&hms in new residential construction must be directly connected
to the lighting circuit with no intervening wall switch. Line cord connected, direct plug-in
and battery-powered alarms are not acceptable. Carbon monoxide alarms are required on
each level of one-family, two-family and multiple dwellings on which sleeping quarters are
located. Installation of CO alarms for new construction shall be certified by an Electrical
Inspection Agency or Municipal Official duly authorized or approved by the municipality
having jurisdiction over the building construction. Submission of a completed Certificate of
Installation (found on the back of this instruction sheet) is required as proof of compliance.
The original certificate must be submitted to the SCDHS before final approval to occupy
the dwelling will be issued.
Each alarm shall be mounted in accordance with th6 manufacturer's instructions. Alarms
shall be mounted in all locations as required by Suffolk County Department of Health Services;
Carbon Monoxide Alarm Standards.
Carbon monoxide alarms are not mandated for existing one and two family homes, but
they are strongly recommended if the home has an attached garage or any type of fuel burning
appliances. For more information, call the Office of Pollution Control at (631) 854-2540. For a
fact sheet on CO poisoning, call the SCDHS CO Hotline at (631) 853-2911.
THE ORIGINAL SIGNED COPY OF THIS FORM must be completed by an Electrical
Inspection Agency or in-honse Electrical Inspector approved by the town or village of
jurisdiction to perform electrical compliance inspections. This Original Certificate must be
submitted to the SCDHS before final approval to occupy the dwelling will be issued.

The attached plan, when duly signed by a representative of the Department, constitutes a pemfit to construct a water
supply and/or collection system for the property as depicted. The applicant should take note of any conditions of
approval, which may be indicated on the plan or enclosed herein. Construction must conform with applicable
standards including "Standards for Approval of Plans and Construction for Sewage Disposal Systems for
Single Family Residences" and "Standards and Procedures for Private Water Systems." Omissions, errors or
lack of details on the plan does not release the applicant from the responsibility of having the construction done in
conformance with applicable standards.
The permit (plan) expires three (3) years after the approval date. Any modifications which may affect the proposed
sewage disposal or water supply systems requires submission of a revised plan and additional fees (if applicable) for
reapproval prior to construction. No inspections will be performed by the Department on expired
permits.
Permits may be renewed, extended, transferred or revised in accordance with the procedures described in
"Submission Requirements for Approval of Sewage Disposal and Water Supply Facilities for Single Family
Dwellings" (Form WWM-041).
It is the applicant's responsibility to call the depamnent at 852-2097, in advance, to arrange inspections of the
sewage disposal and/or water supply facilities prior to backfilling. These include inspections of the sewage
collection and disposal systems, water supply system components and piping, and final grading as shown on the
approved plans. In certain cases, inspections of the soil excavation may be required to determine the acceptability of
the soils for sewage disposal systems. The Department must be notified at least 24 hours in advance to schedule
an inspection and excavation inspections must be confirmed by calling 852-21 OO prior to 9:30 A.M., the morning
of the inspection. Article VII of the Suffolk County Code, "Septic Industry Businesses," requires that all installers
of septic systems within Suffolk County shall possess a valid license from the Suffolk County Office of Consumer
Affairs. This ~~ice can refuse t~ perf~rm inspecti~ns ~r grant~nal appr~va~ f~r the c~nstructi~n ~f pr~jects that
are installed by an unlicensed individual. It is, therefore, in your best interest to utilize a cesspool contractor with a
valid license to avoid substantial delays in your project.
