MATHEW BARNEY, residing at 425 West 13th Street, New York, New York, 10014
party of the first part,
MARY K. FARLEY, residing at 265 Lafayette St., #10C, New York, New York, 10012
party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTEN ($10.00) dollars,
lawful money of the United States paid by the party of the second part, does hereby grant and release unto
the party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being at Peconic, Town of Southold, County of Suffolk and State of New York,
bounded and described as follows:
BEGINNiNG at a point on the northerly line of a 33 foot right of way over land of the party of the first part,
said point of beginning being North 82 degrees 49 minutes East 265.00 feet along said northerly line from
the easterly boundary of land formerly of Floyd Vail (now Williamson), said point of beginning being the
southeasterly comer of land now or formerly of Anthony D. Hughes and Susan A. Hughes;
RUNNiNG THENCE from said point of beginning along said land of Hughes, North 31 degrees 20 minutes
West, 298.45 feet more or less to ordinary high water mark of Long Island Sound;
THENCE easterly along a tie line which marks the said high water mark of Long Island Sound North 70
degrees 57 minutes 33 seconds East 74.15 feet to lands now or formerly of Charles Smithen and Marcia
Smithen;
THENCE along said land South 31 degrees 20 minutes East 315.15 feet to said northerly line of said 33
foot right of way;
THENCE along said northerly line of said 33 foot right of way, South 82 degrees 49 minutes West, 79.40
feet to the point of BEGINNiNG.
TOGETHER WITH a right of way 33 feet in width for egress and ingress, to the public highway known as
North Road, running along the southerly line of the premises herein described and the northerly line of said
right of way, the following courses and distances:
1. North 82 degrees 49 minutes 00 seconds East, 352.30 feet;
2. North 67 degrees 50 minutes 30 seconds East, 263.62 feet;
3. North 81 degrees 22 minutes 00 seconds East, 355.37 feet;
TOGETHER WITH a right of way 20 feet in width leading from the said above described right of way
through other land now or formerly of Nelson Axien and continuing through lands now or formerly of
Henry Smith and thence continuing one (1) rod in width along the easterly side of lands of George
Stepnoski.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated
January 29, 1999 recorded in the Office of the Clerk of the County of Suffolk on February 8, 1999 in Liber
11944 page 291.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
)remises.
['O HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first
above written.
