This Indenture, made this16~h day of September Two Thousand and Three
between
Rivka Schoenfeld and Craig M. Shields, as Trustees of the Rivka Schoenfeld
Trust Agreement dated 11-15-95, having an office and principal place of business at
800 Salt Marsh Lane, Peconic, NY 11958-1156, party of the first part, and
Rivka Schoenfeld, residing at 800 Salt Marsh Lane, Peconic, NY 11958-1156,
party of the second part,
WITNESSETH:
That the party of the first part, in consideration of One and 00/100 Dollars
($1.00) lawful money of the United States, paid by the party of the second part, does
hereby grant and release unto the party of the second part, her successors and
assigns:
All that tract or parcel of land, situate in Peconic, County of Suffolk, State of
New York, and further described as Section 068.00, Block 03.00, Lot 008.002, being
approximately 1 acre as shown on the Suffolk County Land and Tax Map, bounded
and described as follows (see Schedule A attached hereto), subject to all covenants,
conditions, restrictions, easements and rights of way of record.
Being and intended to be the same premises described in Deed recorded in Liber
11898 Cp. 338.
Together with all the right, title, and interest of the party of the first part, of,
in, and to the land lying in the street in front of and adjoining said premises.
Together with the appurtenances and all the estate and rights of the party of the
first part in and to said premises,
To have and to hold the premises herein granted unto the party of the second
part, her heirs or successors and assigns of the party of the second part forever.
And the party of the first part, in compliance with Section 13 of the Lien Law,
covenants that the party of the first part will receive the consideration for this
conveyance and will hold the right to receive such consideration as a trust fund to be
applied first for the purpose of paying the cost of the improvement and will apply the
same first to the payment of the cost of the improvement before using any part of the
total of the same for any other purpose.
