THIS INDENTURE, made the
BETWEEN
day of November, in the year Two Thousand Two
JEAN (3. DUNKIRK, residing at 130 Bay Avenue, Greenport, New York 11944
party of the first part, and
JAMES D. DUNKIRK, residing at 4520 Willa Creek Drive #100, Winter Springs, Florida
32708; SUSAN PFLUGER, residing at 510 Yennccott Drive, Southoid, New York 11971; and
BARBARA J. VERITY, residing at 3495 Albertson Lane, Greenport, New York ! 1944
party of the second part,'
WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second pan forever,
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected,
situate, lying and being in the Village of Greenport, Town of Southold, County of Suffolk and
State of New York, bounded and described as follows:-
Northerly partly by land now or formerly of Charles Rackctt, partly by land now or formerly
of Edward McCotter, deceased, and partly by land now or formerly of William M. Walters, 43
feet:
Southerly by Bay Avenue, 43 feet;
Easterly by land now or formerly of Lena Wells, 130 feet; and
Westerly by land now or formerly of Charles H. Jackson, 130 feet.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first pan by
deed dated January 18, 1989, and recorded in the Suffolk County Clerk's Office on February
1, 1989, in Liber 10790 page 457, and as residuary beneficiary under the Last Will and
Testament of Edith C. Griffing, deceased.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the
buildings and improvements thereon erected, in and to the party of the first pan.
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as she may choose, to change her remainderman as
follows:
TO or among any one or more members of a class consisting of the party of thc first pares
descendants, in any degree, whether presently living or bom hereafter, in such proportions and
amounts, without regard to equality, outright or in Umt, aa the party of the f~t pan may
direct and appoint during her lifetin~ by a pro~rly written and acknowledged instrument, and
recorded prior to death, making specific refermce to this power of appointment. The party of
the f~t part may not appoint herself, her estate, her creditors or the creditors of her estate,
under any circumstances.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and ail the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the tim part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, ¢ovcnnnts that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
year first above written.
