THIS INDENTURE, made the 29~ day of June, Two Thousand Five BETWEEN CARL H. BLASKO and ELIZABETH G. BLASKO. husband and wife, both residing at 175 Central Avenue, Greenport, New York 11944 party of the first part, and KAREN L. Mac~NALD. residing at 760 Cedarfields Drive, Greenport, New York 11944, party of the second part, WITNESSETH, tlmt the party of the first part, in consideration ofTen Dollars and other valuable consideration paid by the party of the second pm, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected, situate, lying and being in the Village of Greenpon, Town of Southold, Suffolk County, New York, bounded and described as follows: BEGINNING at a point on the southerly side of Central Avenue where the easterly line of land now or formerly of Boutyette and westerly line of premises hereinafter described intersects same; said point being distant 70.80 feet easterly from the comer formed by the intenm:tion of the easterly side of Carpenter Street and the southerly side of Central Avenue; RUNNING THENCE along the southerly side of Central Avenue, North 75 degrees 44 minutes 20 seconds East, 52.88 feet to land now or formerly of White: RUNNING THENC.E along said land, South 07 degrees 03 minutes 50 seconds East, 131.0 feet to land now or f~rmerly of Hendler; RUNNING THENCE along said land, South 75 degrees 26 minutes 00 seconds West, 40.66 feet to land now or formerly of Leden: RUNNING THENCE along said land the following two courses and distances: (1) North 07 degrees 14 minutes 00 seconds West, 43.37 feet; (2) South 76 degrees 28 minutes 10 West 12.40 feet to land now or formerly of Boutyette: RUNNING THENCE along said land North 06 degrees 55 minutes 10 seconds West, ~2.30 feet to the southerly side of Central Avenue to the point or place of BEGINNING. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated May 10, 1968, and recorded in .the Suffolk County Clerk's Office on May 21, 1968, in Liber 63~,0 page 257. RESERVING. HOWEVER, a legal life estate in the above-described premises with the buildings and improvements thereon erected, in and to the party of thc first part. THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF APPOINTMENT, exercisable as often as they may choose, to change their remainderman as follows: TO or among any one or more members of a class consisting of the pnrty of the first pan's descendants, in any degree, whether presently living or bom hereafter, in such proportions and amounts, without re. rd to equality, outright or in trust, as the party of the first part may direct and appoint during their lifetime by a properly written and acknowledged instrument, and recorded prior to death, making specific reference to this power of appoinnncnt. Thc party of the first part nmy not appoint themselves, their estates, their creditors or the creditors of their estate, under any circumstances. ~'~I_!~ DEED Lq AN EXERCISE OF THE SPECIAL POWER OF APPOINTMENT contained in a certain prior deed in respect to the above-described premises dated March 7, 2000, recorded in the Suffolk County' Clerk's Office on April 19, 2000, in Libel' 12036, Page 207; and it is further stated that the party of the first part continues to reserve a special power of appointment as hereinabove set forth. TOGETHER with ail right, title and interest, if any, of the pasty of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and ali the estate and rights of the pasty of the f'tmt part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the pasty of the second part, the heirs or successors and assigns of the pa~y of the second part forever. AND the party of the first part covenants that the I)~u'ty of the first part hn~ not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien lnw, covenants that the patty of the first pa~ will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the mst of the improvement before using any part of the total of the same for any other purpose.
