Hempstead, NY 11550 as Executor of the Estate of Florence Rafuse as surviving tenant by the entirety, (Suffolk County Surrogate's Court File No. 1890P2001) party of the first part, and DONALD G. RAFUSE, residing at 650 Irene Street, S. Hempstead, NY 11550 party ofthe second part, WITNESSETH, that the party of the first part, to whom DONALD G. RAFUSE letters testamentary were issued by the Surrogate's Court, Suffolk County, New York on October 17, 2001 and by virtue of the power and authority given in and by said last will and testament, and/or by Article 11 of the Estates, Powers and Trusts . Law, and in consideration of Ten dollars and other lawful consideration, paid by the party of the second part, does hereby grant and release unto the party of the second part, the distributees or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, sitaate, lying and being in the Town of Southold, County of Suffolk, State of New York, shown and designated on a certain map entitled "Map of Beixedon Estates, Town of Southold, Suffolk County, N.Y., Property of Grace R. Nickles, formerly Grace Rogers DeBeixedon," made by Otto W. Van Tuyl, Licensed Surveyor, and filed in the Suffolk County Clerk's Office on March 16, 1946 as Map No. 1472, as and by Lot Numbered 11 in Block Numbered 2 on said Map. TOGETHER with all of the right, title and interest of the part of the first part of, in and to the land lying in the bed of any street, road or avenue in front of or adjoining said premises to the center line thereof. TOGETHER with the right ot pass and repass over the roads, streets and avenues shown on said Map, and the right, in common with other owners, of the lots shown on said Map, to use the beaches designated on said Map as Plot A and Plot B respectively, solely for recreation and not for commercial purposes. TOGETHER with a non-exclusive right to dredge (for the sole purpose of facilitating access by boat to and from Southold Bay) in Petty's Pond on the westerly side of the line running South 1 degree 05 minutes 20 seconds East and South 22 degrees 21 minutes 00 seconds East and South 43 degrees 05 minutes 30 seconds East (as indicated on said map), to within 5 feet of the easterly boundary of all lots southerly of Lot 10 in Block 2 on said map, Grace R. Nickles reserves to herself, her heirs and assigns, all the right, title and interest to the lands under water of Petty's Pond. This is a Confirmatory Deed pursuant to the Last Will and Testament of Florence Rafuse. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof, TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time of decedenfs death in said premises, and also the estate therein, which the party of the first part has or has power to convey or dispose of, whether individually, or by virtue of said will or'otherwise, TO HA VEAND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such NYSBA Residential Real Estate Forms on HotDocs® (9/00) Copyright Capsott® Development consideration as a trust fund to be applied first for the purpose of paying the costs of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
