THIS INDENTURE, made the/z/ day of Saptember, two thousand and six
BETWEEN Gus C. Klavas and Angola Klavas, his wife, residing at 166-07 14th Road, Beechhurst,
New York 11357,
party ofthe first part, and
Gus C. Klavas and Angela Klavas, residing at 166-07 14th Road, Beechhurst, New York ! 1357, as
tenants in common without right of survivorship,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the pafly of
the second part, thc heirs or successors and assigns of thc party ofthe second part forever, all oftheir
right, title and imerest in:
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being in the Town of Southold, County of Suffolk and State of New York, known
and designated as Lot No. 15 in Block 2 on a certain map entitled "The Map of Beixedon Estates,
Town of Southold, Suffolk County, N.Y., Property of Grace R Nickles, formerly Grace Rogers
DeBeixedon, made by Otto Van Tuyl, Licensed Surveyor", and filed in the office of the Clerk of the
County of Suffolk on March 16,1946 as Map No. 1472.
TOGETHER with the right to pass and repass over the wsds, streets and avenues shown on said
map, and the right, in common with other owners of the lots shown on said map, to use the beaches
designated on said map as Plot A and Plot B respectively, solely for recreation and not for
commercial purposes.
TOGETHER with a non-exclusivc right to dredge (for thc sole ptupose of facilitating access by boat
to and from Southold Bny) in Perry's Pond on the westerly side of the linc running South 22' 21'
00" East and South 43' 05' 30" East (as indicated on said Map), to within five feet of the easterly
boundary of all lots southerly of lot 14 in Block 2 on said Map. Grace R. Nickles has reserved to
herself, her heirs and assigns, all the right, title and interest to the lands under water of Petty's Pond.
BEING AND INTENDED TO BE the same premises as was convey~d to the party of the first part
herein by Armand C. Hovell and Liilinn Hovell, by deed recorded in Liber 7994 at Page 16, and
known as and by Street Number ! 155 Arshamomnque Avenue, Southold, New York.
TOGETHER with all right, title and intorest, ifany, oftbe party of'thc first parl of, in and to any
streets and reeds abu~ng thc above described premises to the center thereof; TOGETHER with
appurtenances and all the eslate and riF, hts ofthe party o£the first part in and to said premises; TO
HAVE AND TO HOLD the premises herein granted unto the party of thc second part, the heirs or
successors and assigns of the party o£the second pn~ forever.
AND thc party of the first part covenants thai the party of thc first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of thc first part will receive thc consideration for this conveyance and will hold the fight to
receive such consideration as a trust fund to bc applied first for the purpose of paying thc cost of thc
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it reads "parties" whenever thc sense ofthis indenture so
requires.
IN WITNESS WHEREOF, the party of thc first part has duly executed this deed the day and ycar
first above written.
