by the entirety of Gabriel F. Zillo, deceased /~/..~
party of the first part,
THE VILLAGE OF GREENPORT, a municipal corporation doing business at 236 Third Street,
Greenport, New York, 11944
party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTEN ($10.00) dollars,
lawful money of the United States paid by the party of the second part, does hereby grant and release unto
the party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being in the
SEE SCHEDULE "A" ANNEXED HERETO
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and'to said
premises.

TO HAVE AND TO HOLD the premises herein gr ed unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the'party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires. .
SCHEDULE 'A'
ALL THAT CERTAIN plot, piece or parcel of land, situate, lying and being in the Village of
CJreenport, Town of Southold, County of Suffolk and State of New York, being more particularly bounded
and described as follows:
BEGINNING at a point along the southerly side of Ludlam Place distant 412.87 feet easterly from
the comer formed by the intersection of the southerly side of Ludlum Place and the easterly side of
Carpenter Street;
THENCE along the southerly side of Ludlam Place, North 75 degrees 44 minutes 30 seconds East,
44.20 feet to a point and the Map of Stifling Cove Condominium filed with the Clerk of Suffolk County as
Map No. 106;
THENCE along said map South 14 degrees 11 minutes 40 seconds East, 69.90 feet to a point;
THENCE westerly through the land of Jean A. Zillo South 80 degrees 12 minutes 40 seconds West
43.67 feet to a point and the land now or formerly of Frank A. Field Realty, Inc.
THENCE northerly along said land North 14 degrees 46 minutes 00 seconds West, 66.50 ti:et to the
'southerly side of Ludlam Place and the point or place of BEGINNING.
BEING AND INTENDED TO BE part of the premises described in the deed to Jean A. Zillo and
Gabriel F. Zillo, her husband, since deceased by deed dated December 31, 1953 recorded in the Office of the
Clerk of the County of Suffolk on January 13, 1954 in Liber 3638 page 453.
THE PREMISES HEREIN shall not be improved by a residential dwelling or residential accessory
'structure. This covenant and restriction shall run with the land.
