residing at 576 Gardenia Street, West Hempstead, NY 11552
party of the first part, and
MARION K~LSBY, residing at 269 West 12th Street,
Apt. #1-2, New York, NY 10014
party of the second part,
Witnesseth, that the party of the first part, in consideration of Ten
Dollars and other valuable consideration paid by the party of the second
part, does hereby grant and release unto the party of the second part,
the heirs or successors and assigns of the party of the second part
forever, ALL that certain plot, piece or parcel of land with the
buildings and improvements thereon erected, situate, lying and being in
the Village of Greenport, Town of Southhold, County of Suffolk and State
of New York, bounded and described as follows: BEGINNING at an iron pipe
on the northerly side of Wiggins Street, distant 265.50 feet Easterly
from the corner formed by the intersection of the northerly side of
Wiggins Street with the Easterly side of Fourth Street, said point of
beginning also being where the division line between the premises herein
described and land now or formerly of Albert Grilli intersects the said
northerly side of Wiggins Street; RUNNING THENCE along said division
line, North O0 degrees 16 minutes 20 seconds West, 121.98 feet to an iron
pipe and land now or formerly of Henri Lauwers and another; THENCE along
said last mentioned land, North 84 degrees 46 minutes 50 seconds ~,~W-
53. O0 feet to land now or formerly of Veronica Brewer; THENCE along said
last mentioned land, South O0 degrees 40 minutes 10 seconds East, 128.33
feet to a granite monument on the northerly side of Wiggins Street;
THENCE along the Northerly side of Wiggins Street, North 88 degrees 22
minutes 30 seconds West, 53.72 feet to the point or place of BEGINNING.
SAID PREMISES being known as No. 320 Wiggins Street, Greenport, New York.
The grantor herein being the same person as.the grantee and the premises
being the same as described in a certain deed dated 12/03/98 and recorded
1/22/99 in Liber 11940 Page 942.
Together with all right, title and interest, if any, of the party of the
first part in and to any streets and roads abutting the above described
premises to the center lines thereof; Together with the appurtenances and
all the estate and rights of the party of the first part in and to said
premises; To Have And To Hold the premises herein granted unto the party
of the second part, the heirs or successors and assigns of the party of
the second part forever. And the party of the first part covenants that
the party of the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever, except as
aforesaid. And the party of the first part, in compliance with Section
13 of the Lien Law, covenants that the party of the first part will
receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the
purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part
of the total of the same for any other purpose. The word "party" shall
be construed as if it read "parties" whenever the sense of this indenture
so requires.
