TH IS INDENTURE, made the 4's day of September, Two Thousand Three

LARRY IL RltODES, residing at 79 Sound Beach Blvd., Sound Beach, New York 11789, as Executor
of the last will and testament o1' Mary Lee Rhodes, ,who died on the 25~ day of August, Two Thousand

PETER STOUTENBURGH, residing at 2885 Indian Neck Lane, Peconic, New York 11958, party of
Ihe second part,
WITNESSETH, that the party of the first part, to whom letters testamentary were issued by the
Surrogate's Court, Suffolk County, New York on March 24, 2003, and by virtue of the power and
authority given in and by said last will and testament and/or by Article ! ! of the Estates, Powers and
Trusts Law, and in consideration of TWO HUNDRED SIXTY THOUSAND (S260,000.00) DOLLARS,
paid by the party ofthc second part, does hereby grant and release unto the party of the second part, the
distributees or successors and assigns of thc party of the second part forever,
ALL that certain plol, piece or parcel of land, with Ihe buildings and improvements thereon erected,
situate, lying and being at Greenport, in the Town of Southoid, County of Suffolk and Slate of New
York, bounded and described ns follows:
BEGINNING at the coruer formed by the intersection of the weslerly side of Third Street with the
northerly side of Wiggins Street;
RUNNING THENCE from said point or place of beginning along the northerly side of Wiggins Street
North 88 degrees 21 minutes 20 seconds West 113.55 feet to land now or formerly of Ann B. and Robert
A. McCaughey;
THENCE along said last mentioned land North 6 degrees l0 minutes 20 seconds West 47.98 feet to land
now or formerly of Mary Teresa and Scott Dunne;
THENCE along said last mentioned land Noah 89 degrees 39 minutes 00 seconds.F, ast 112.63 feet to
the westerly side of Third Street;
THENCE along the westerly side of Third Street South 6 degrees 40 minutes 00 seconds East 52.00 feet
to the comer first above mentioned nl the point or place oFBEGINNING.
BEING AND INTENDED TO BE thc same premises conveyed to Mary L~.'c Rhodes by deed dated July
20, 2000, and recorded August 2:5. 2000, in thc Office of thc Suffo{k County C{erk in Liber 12066, Page

TOGETHER with all right, titlc and interest, if any, of the party of the first part in and to any streets
and roads abutting the above described premises to the center line thereof,
TOGETHER with the appurtenances, and also the estate which the said decedent had at the time of
decedcnt's death in said premises, and also the estate therein, which the party of the first part has or has
the power to convey or dispose of, whether individually, or by virtue of'said will or otherwise,
TO HAVE AND TO HOLD the premises herein granted unto thc party of the second part, thc
distributees or successors and assigns of the party of the second part forever.
AND the party of' the first part covenants that the part~ of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 ofthe Lien Law, covenants that the party
of the first part will reccivc the consideration for this conveyance and will hold the right to receive such
consideration as a trust fired to be applied first for thc purpose of paying the cost of improvement and
will apply same first to the payment of thc cost of improvement before using any part of the total of the
same for any other purpose.
Thc word "party" shall be construed as if it reads "parties" whenever thc sense of this indenture so
requires.
