party of the second part,
!WlTNESSETH, that the party of the first part,, in consideration of One Hundred Twelve Thousand Five
Hundred'($112,500.00) Dollars add bther valuable considerations paid by the party of the second part,
does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the
party of the second part forever,
ALL that certain plot', piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at Peconic, in the Town of Southold, County of Suffolk and State of New York,
known and designated as Lot Number 34 on a certain map entitled "Map No. 2 of Peconic
Shores, Peconic, LI., N.Y. property of B.B. Bailey and C. H. Bailey," D.R. Young, Surveyor,
Riverhead, N.Y., and filed in the Suffolk County Clerk's Office on September 15, 1930, as
Map No. 654.
SUBJECT to any state of facts an inspection of the premises would disclose.
RESERVING, however, to the party of the first part the right to dedicate any and all roads as
laid out on said map to the Town of Southold as public highways; and the party of the
second part hereby consents and agrees that the party of the first part shall have the right to
dedicate any particular highway or highways or all highways set forth on said map to the
Town of Southold as public highways, without oStai~in~ any"further consent from the party
ofl.the second part; and the party of the second part hereby releases the Town of Southold
from any claim for damages by reason thereof.
SUBJECT further to the covenant and restriction that there shall be no outside toilet erected
on any part of the said premises.
SAID PREMISES being known as and by the street address o~ 85 SECOND AVENUE,
SOUTHOLD, NEW YORK and the Suffolk County Tax Map as 473889 67.-2-18.
PREMISES BEING AND INTENDED to be the same premises conveyed to ANDREW G.
BINDNER Ill, MARILYN FAZIO and BRUCE D. BINDNER, as Tenants In Common, by dee~l
from Bruce D. Bindner as Executor of the Last Will and Testament of Mary J. Bindner,
deceased, dated December 11, 1993, recorded December 13, 1993 in Suffolk County in
Liber 1165~ CP 644.
THIS DEED IS INTENDED TO CONVEY THE ONE-HALF (~) INTEREST OF ANDREW G.
BINDNER also known as ANDREW G. BINDNER, II1.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and dghts of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
p~:emises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not don~e or suffered anything
whereby the said premises have been encumbered in any way whatever, e~<cept as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the dght to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
:first to the payment of the cost of the improve_merit before using any-part of the total of the sam~@ ~or ~ny other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.
