WITNESSETH, that the party of the first part, in no consideration o.f . and other valuable considerations paid
by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at Peconic, in the Town of Southold, County of Suffolk and State of New York,
known and designated as Lot Number 34 on a certain map entitled "Map No. 2-of Peconic
Shores, Peconic, Li., N.Y. property of B.B. Bailey and C. H. Bailey," D.R. Young, Surveyor,
Riverhead, N.Y., and filed in the Suffolk County Clerk's Office on September 15, 1930, as
Map No. 654.
SUBJECT !o any.state of facts an inspection of the premises would disclose.
RESERVING, however, to the party of the first part the right to dedicate any and all roads as
laid out on said map to the Town of Southold as public highways; and the party of the
second part hereby consents and agrees that the party of the first part shall have the dght to
dedicate any particular highway or highways or all highways set forth on said map to the
Town of Southold as public highways, without obtaining any further consent from the party
of the second part; and the party of the second part hereby releases the Town of Southold
from any claim for damages by reason thereof.
SUBJECT further to the covenant and reslriction that there shall be no outside toilet erected
on any part of the said premises.
SAiD PREMISES being known as and by the street address of 85 SECOND AVENUE,
SOUTHOLD, NEW YORK and the Suffolk County Tax Map as 473889 67.-2-18.
PREMISES BEING AND INTENDED to be the same premises c'onveye~ to the ANDREW
G. BINDNER and MARY J. BINDNER, late of Queens County, now deceased, in Deed
dated April 11, 1959 and reco,rde¢_in Suffol~k Coun, tyin Liber 4642 at page 76.
TOGETHER with all dght, title and interest, if ~ny, of the party of the first part in and to affy streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and righls of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.·
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for lhe purpose of paying the cost of the improvement and will apply lhe same
first to the payment of lhe cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.
