THIS INDENTURE, made the ! 9t~ day of April, Two Thonsand Five BETWEEN ERNEST W. PAINTER, JR. and ROBERTA S. PAINTER, his wife, residing at 2555 Youngs Avenue, Unit 17E, Southold, New York 11971, party of the first part, and MARILYN E. RAINES, residing at 4.20 Sharon Drive, Cheshire, Connecticut 06410, and, BARBARA J. North 70 degrees 05 minutes 00 seconds East 487.72 feet; (2) North 76 degrees 22 minutes 20 seconds East 567.10 feet to the westerly side of Railroad Avenue at the point or place of BEGINNING. Together with an undivided 1/45'i, inte~'st in the Common Elements. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated i/30/01 and recorded 2/6/01 in the Office of the Suffolk County Clerk in Liber 12101, Page 201. R .ESERVING, HOWEVER, a legal life estate in the above-described premises with the buildings and hnpmve~nents thereon erected, in and to the party of the first part. THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF APPOINTMENT, exercisable as often as they may choose, to change their remainderman as follows: TO or among any one or more members of a class consisting of the party of the first part's descenrlnn~, in any degree, whether presently living or bom hereafter, in such proportions and amounts, without regant to equality, outright or in mist, as the party of the first pan may direct and appoint during her lifetime by properly written and acknowledged instrument, and recorded prior to death, making specific reference to this power of appointment. The party of the first pan may not appoint themselves, their estate, their creditors or the creditors of their estate, under any circumstances. AND the party of the first pan covenants that the party of the first pan has not done or suffemt anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the patty of the first pat~, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the tight to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any pa~ of the total of the same for any other purpose. · The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
