HomeMy WebLinkAboutL 12199 P 868Lt':' ' -:::'? 7 L_ BARGAIN AND SALE DEED (CONDOMINIUM UNIT) THIS INDENTURE, made as of July 16, 2002, among Diane-~ Brisotti, having an address at 4700 Ole Jule Lane, Mattituck, NY 11952 ("Grantor"), and Carl Butkovich and his wife Bruna Butkovich, each having an address at 5845 N. Bayview Rd., Southold, NY 11971 (collectively hereinafter refexTed to as "Grantees"). WITNESSETH, that Grantor, N'~onsidera~ion of Ten Dollars and other valuable consideration, the receipt and sufficiency of which hereby are acknowledged, does hereby grant and release unto Grantees, as tenants by the entirety, and their heirs, executors, administrators, successors and assigns forever, THAT CERTAIN condominium unit, more fully described in Schedule A hereto, designated as Unit 11E in the building known by the street address 2555 Youngs Avenue, Southold, the County of Suffolk, and the State of New York, in the condominium known as Founders Village (the "Condominium"), TOGETHER with the percent interest in the common elements of the Condominium allocated to the Unit, as described in the declaration recorded on February 2, 1987 in the Office of the Clerk of Suffolk County at, TOGET~IER with all right, title and interest, if any, of Grantor in and to any streets and roads abutting said premises to the center lines thereof, TOGETHER with the appurtenances and all the estate and rights of Grantor in and to said premises, Being and intended to be the same premises conveyed to the Grantor by deed made by Albert J. De'Santis, individually and as surviving spouse of Marguerite DeSantis, deceased, and recorded October 3, 2000, in Liber 12075 cp 175. TO HAVE AND TO HOLD the premises herein granted unto Grantees, as tenants by the entirety, and their heirs, executors, administrators, successors and assigns forever. Grantor is the owner of said premises. Said premises is not located in an agricultural district. Grantor covenants that Grantor has not done or suffered anything whereby said premises have been encumbered in any way whatever, except as set forth herein. Grantor, in compliance with Section 13 of the Lien Law, covenants that she will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement before using any part of the total of the same for any other purpose.
