valuable consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
All that certain, plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being in the Town of Southold, County of Suffolk and State of New York, known
and distinguished by Lot No. 28 on Map entitled Subdivision Map of Founders Estates, situate at
Southold, Suffolk County, New York, made by Otto W. Van Tuyl, Engineer and Surveyor, dated
3/18/27 and filed in the office of the Clerk of Suffolk County on 5/10/27 as Map No. 834, and on said
map bounded northerly by Lot 27, easterly by Founders Path, southerly by Lot 29, westerly by Lot
16, being 150 feet on said northerly boundary, 75 feet on said easterly boundary, 149.38 feet on
said southerly boundary, and 75 feet on said westedy boundary.
BEING AND INTENDED TO BE the same premises as conveyed to the party of the first part by
deed dated May 13, 1998 and recorded in the Office of the Clerk of the County of Suffolk on May 26,
1998 in Liber 11895 page 280 and as devised to the party of the first part under the will of Peter G.
Bogovich, who died a resident of Suffolk County on October 17, 1997, and whose will was admitted
to probate by the Surrogate's Court of Suffolk County on December 21, 1997; said Douglas
Bogovich and Douglas C. Bogovich, Sr. being the same person.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
}remises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
