AND SALE DEED WITH COVENANT AGAINST GRANTOR'S
ACTS (INDIVIDUAL OR CORPORATION)

PURCHASER BEFORE SIGNING.
THIS INDENTURE, made the 22nd day of January, two thousand and two,
between Martha Ohlmann, of 145 Founders Path, Southold, New York 11971, as surviving spouse of John
Ohlmann, party of the first part,
and John Ohlmann, Maureen Ohlmann, both of 902 Sixth Street, East Northport, New York 11731 and
Stanley Swenson and Audrey Swenson, both of 3925 Mill Road, Seaford, New York 11783, as tenants-in-
common, party of the second part, .~
WITNESSETH, that the party of the first part, in ~onsideration of Ten Dollars and No Cents ($10.00), lawful

of the second part, the heirs or success~ors and assigns of tbe party of the second part forever,

ALL that certain plot, p~ece or parce of land, wtth the buildings and improvements thereon erected, situate,
lying and being in the Town of Southold, County of Suffolk and State of New York, shown and designated as
Lot #49 and the northerly part of Lot #50 on a map entitled, "Subdivision Map of Founders Estates, situate at
Southold, New York", made by Otto W. Van Tuyl, Engineer and Surveyor, Greenport, New York, March
1927, and filed in the Suffolk County Clerk's Office at Riverhead, Suffolk County, New York on the 10th day
of May, 1927 as Map #834 and being more particularly bounded and described as follows:
BEGINNING at a point on the easterly side of Founders Path distant 131.62 feet southerly from the corner
formed by the intersection of the southerly side of Korn Road with the easterly side of Founders Path;
RUNNING THENCE North 67 degrees 38 minutes 40 seconds East, 140.73 feet; RUNNING THENCE South
22 degrees 21 minutes 20 seconds East, 62.50 feet; RUNNING THENCE South 67 degrees 38 minutes 40
seconds West, 133.89 feet to the easterly side of Founders Path; RUNNING THENCE along the easterly side
of Founders Path North 28 degrees 35 minutes 40 seconds West, 62.87 feet to the point or place of
BEGINNING.
BEING and intended to be the same premises as those conveyed to John Ohhnann and Martha Ohlmann, by
deed dated January 15, 1974, and recorded in the Suffolk County Clerk's Office on January 28, I974 in Liber
7578, page 272.
SAID premises known as 145 Founders Path, Southold, New York.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
premises,
TO HAVE AND TO HOLD the premises heroin granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part, covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will
apply the same first to the payment of the cost of the improvement before using any part of the total of the
same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
