SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated April 17, 2008 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 18,680 square foot parcel in the R40 District, measuring 144.85 feet along Sound View Avenue Extension to the south, 148.33 + 240.21 feet along the western boundary, 48.14 feet along the Long Island Sound to the north, and 227.79 feet and 205.74 feet along the eastern boundary. The lot is improved with a single-family dwelling, a frame accessory garage and a flame accessory shed, as shown on the survey by John T. Metzger, L. S. dated December 10, 2007. BASIS OF APPLICATION: Request for Variances under Sections 280-124 and 280-116, based on the Building Inspector's March 17, 2008 Notice of Disapproval concerning a proposed new single-family dwelling with a new foundation following demolition of the existing building), for the reasons that: (1) the setback from the top of the bluff adjacent to the Long Island Sound will be less than 100 feet; (2) the minimum code standards under Sections 280-9 and 280-10 require a minimum of 15 feet on a single side and minimum 35 feet combined side yard setbacks; (3) the lot coverage will exceed the code limitation of 20% with a buildable lot size of 13,369 square feet. LWRP DETERMINATION: The Southold Town LWRP Coordinator has determined that the proposed action is inconsistent with LWRP Policy standard, which require a 100-foot setback from the top of the bluff. The Coordinator recommends that the application be amended to meet the 100-foot standard to the greatest extent practical to maximize the difference from the coastal erosion hazard area to minimize the potential of future of structural loss due to slope failure or erosion. The Board finds the action consistent with LWRP pohcies. Except for an approximate six- foot wide portion of the boundary hne 90 feet from the house, the subject property is bounded on the bluff side by an adjacent neighbor's property, not by the top of the bluff. The 62-foot setback reported by the LWRP Coordinator, while it is not the distance of the house from the bluff but from the boundary between the subject property and an adjacent neighbor's property, is nevertheless the relevant setback for LWRP purposes. The house on the subject property is preexisting and is set back from the top of the bluff farther than is the adjacent dwelling that exists on the property between the subject and the top of the bluff. The LWRP Coordinator also recommends that a minimum of 20 feet non-turf, native vegetation buffer landward of the wetland line be required. ADDITIONAL INFORMATION The subject property consists of two lots that have been combined as a single building lot. CTM 10 is identified as a right of way lying to the west of lot 11, which contains the existing house. Part of the existing garage portion of the house lies within the right of way. The March 17, 2008 Notice of Disapproval indicates a proposed setback of 90 feet from the top of the bluff. That distance was based on a measurement to the closest point of the bluff on the subject property. The shortest distance fi'om the house to the top of the bluff in a neighbor's property is 62 feet. RELIEF REQUESTED: The applicant seeks variances for a reduced west side setback of from 15 feet to 6.3 feet, and a reduction of total side setback from 35 feet 14.5 feet. The applicant also seeks approval for a 90 foot setback from the top of the bluff, and a reduction in front yard setback from 35 feet to 17.4 feet. In addition, a variance for 20.6% lot coverage is requested. ALTERNATIVE RELIEF REQUESTED: An amended plan was submitted on July 17, 2008, together with a revised survey which indicates a decrease in the width of the house, resulting in an increase in the total side yard setback from 14.5 feet to 18 feet. The flame shed shown on the Survey of December 7, 2007 and its revised versions of January 8, 2008, and March 4, 2008 will be removed. The decrease in the width of the house will eliminate the need for a variance for lot coverage variance. The proposed construction is an alteration and not a demolition and reconstruction as it was described on the March 17, 2008 Notice of Disapproval. Page 3 - September 4, 2008 ZBA # 6157 - John Scourakis, Applicant CTM 1000-50-2-10 & 11 (combined area) REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3)(b)(3)(1). Grant of setback variances will not have an adverse environmental effect on the character of the neighborhood or be a detriment to nearby properties. The amended site plan has eliminated the need for a variance for the west side setback. The east side setback will be unchanged. The proposed addition to the footprint of the existing house will not encroach further toward the top of the bluff. The house will remain farther from the top of the bluff than is the house on the adjacent property. The bluff itself is vegetated and stable. 2. Town Law §267-b(3)(b)(2). The benefit of an expanded and renovated house cannot be achieved by some method, feasible for the applicant to pursue, other than area variances. Any change in the position of the rear yard setback from the top of the bluff would require a significant reduction in the size of the addition or require variances for other setbacks. 3. Town Law §267-b(3)(b)(3). The variance is not substantial. The existing house will retain its eastern side setback, and the western side setback will be increased. The proposed eastern side setback will remain unchanged. The variance for total side yard setback, from 35 feet to 18 feet, is substantial but is less than the existing total setback. The variance requested for the setback to 90 feet from the top of the bluff, at the rear yard, is 11 percent. The existing front yard setback will be extended but will not exceed the existing nonconforming setback. 4. Town Law §267-b(3)(b)(5). The need for a variance was self-created only so far it is a consequence of a decision to build an addition to the house. The need for a variance for the house as expanded is a result of the unusual shape of the lot and the configuration of the existing house. 5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that grant of this relief will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Town Law §267. The grant of the variance is the minimum action necessary and adequate to enable the applicants to enjoy the benefit of the alterations and extension of the existing house, while preserving and protecting the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Weisman, and duly carried, to GRANT the variances as applied for, subject to the following CONDITIONS: 1. Repair the existing stairwells leading from the bluff to the beach below (as per Town and State agency permits to be issued prior to taking this step). 3. Recommendation as per April 22, 2008 Letter from Suffolk County Soil & Water Conservation District (regarding recommendation of maintenance/cutting of trees along the bluff-edge top and bluff face, and removal of cuttings and other debris). 4. Non-turf native vegetation buffer landward of the top of the bluff. 5. The status of lot 10 as a right-of-way with access rights for neighbors must be extinguished before a building permit can be issued. The above conditions shall be written into the Certificate of Occupancy by the Building Department before issuance. Any deviation from the variance given such as extensions, or demolitions which are not shown on the apphcant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. No. 6157 (Scourakis) Dear Mr. Goehringer: We have completed a site inspection of the parcel located at 955 Soundview Avenue Extension in Southold as you have requested. This parcel has an existing home with a well established lawn. Most of the rear yard leading to the bluff- top slopes away from the bluff toward the house and front yard. Roof water runoff at the present time is directed to gutters and downspouts but exits onto the ground surface. After new construction takes place, new gutters and downspouts should be directed into drywells to alleviate the surface water runoff. There is an existing stairwell leading down to the beach below. It is built in small sections separated by two narrow paths that lead across the bluff face. These paths are well grassed. Most of the stairs are in good condition. The stair section immediately above the beach level has been twisted and has come apart at the railing. This will need to be repaired as it is now too dangerous to use. Along the paths it was noted that cut limbs and tree trunks are lined along the outer edge of the path. There was also cuttings noted left piled on the bluff face. This practice should be eliminated since debris only adds weight to the sandy soils and smothers existing vegetation. Trees along the bluff-top edge or on the bluff face should be cut down at their bases and removed. When trees are allowed to grow to any significant height they begin to cause an erosion hazard since the high winds can loosen the root system and cause the trees to tumble down the slope face and cause considerable damage. The toe of the slope does not appear to be reached by normal high tides. Storm level tides however can reach the toe of the slope. It appears that the slope is in a relatively stabile condition at the present time and no further work is needed other than the stairwell repair. No. 6157 (Scourakis) The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the denoted following Policy Standards and therefore is INCONSISTENT with the LWRP. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 1. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development which is not water-dependent as far away from coastal hazard areas as practical. Avoid hazards by siting structures to maximize the distance from Coastal Erosion Hazard Areas. The distance from the proposed addition from the top-of-bluff is 62'. The use is not "water dependent" and it is recommended that the structure be relocated to maximize the distance from the "coastal hazard area" to minimize the potential of future structural loss due to slope failure or erosion. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. The distance from the proposed addition to top-of bluff is 62'; a minimum setback distance of 100 feet from the bluffline is required pursuant pursuant to Chapter § 280-116 which states: Building setback requirements adjacent to water bodies and wetlands. Notwithstanding any other provisions of this chapter, the following setback requirements shall apply to all buildings located on lots adjacent to water bodies and wetlands: ,,1.Lots adjacent to Long Island Sound. Fishers Island Sound and Block Island Sound. (1) ,,Ill buildings or structures located on lots adjacent to sounds and upon which there exists a bluff or bank landward of the shore or beach shall be set back not fewer than lOO feet from the top of such bluff. Please require that the applicant amend the application to meet the above policy to the greatest extent practical. If the action is approved the following best management practice (BMP) are recommended: 1. Require a non-turf~ native vegetation buffer landward of the top of bluff. 2. Require gutters, leaders and drywells for the structures. The dwelling is a one-story wood framed building con- structed on a concrete block foundation and consists of two bedrooms, living room, full bathroom, and kitchen. Heat is furnished to all rooms from a gas-fired forced warm air fur- nace located in partial cellar. A raised deck is attached to west side of building. A wood framed accessory building is located in rear yard area. Electric water pump for domestic water is located in covered pit on east side of dwelling. The following violations of the Housing Code, Chapter 52, Code of the Town of Southold, New York, were found: Entries - to kitchen and living room, no means of contr~ling light in room at points of entries, Article V, Section 52-56 B 2. La~ cord electric outlets - kitchen and northeast bedroom, Article V, Section 52-56 A 1. Electric hot water heater - leg support rusted away, two remaining legs rusted and weakened, unable to support unit in upright position causing stress on plumbing connections. Unit is not in service, Article V, Section 52-50 A & 52-51 A 1 & D 1. Furnace - gas fired, not connected to suitable chimney. Smoke pipe from furnace runs through bedroom floor and ceiling terminating through roof with type A~smoke pipe. Insufficient clearance from combustable materials, Article V, Section 52-54 B. Electrical - hook up for water pump, splice made in cellar, wires taped and exposed without junction box. Wire from splice to pump motor has no ground wire ~ connection, Article V, Section 52-56 A 1. The Scourakis property has only a narrow unfinished staircase which does not reach the Long ~and Sound beach at the end of the strip of land (formerly shown as a right-of-way) and the Scourakis parcel does not front the Long Island Sound Bluff, exgept, at the end of the strip of land. The parcel to the east maintains an access staircase to the Long Island Sound and contains the top of the bluff. Consequently, Mr. And Mrs. Scourakis can only address the bluff area they own (at the end of the strip of land) and have no control over improvements to the stairs. They will forward the County's observations an~ recommendations to their neighbor to the east regarding bluff maintenance and the condition of the stairway. As I stated in my July 17th letter, t~e owner will accept a non-turf vegetated buffer landward of the top of his bluff (only 25 feet) but has no control on adjacent parcels. The house will have gutters, leaders and drywells. In additIon, the westerly portion of the lot which was once described as a right of way has been merged to the easterly portion of his parcel and according to Mr. Scourakis's title company the right of way is extinguished. Please make a note in your file that condition number 2 can not be addressed since the noted stairs are not on Mr. Scourakis's proDerty and that the observations made by the County are addressing a conaition on the adjacent parcel. I would request that you clarify this to the building department since you have stated that these conditions are to be written into the Certi~cate of Occupancy. I would recommend that your decision be corrected, by your own motion, for purposes of filing with the Town clerk and record keeping.
