SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued a reply dated May 28, 2008 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter- community impact. LWRP EXEMPT: This application is exempt under Town Code LWRP Section 268'BB, since no natural resource feature was found within 100 feet of the proposed construction, as requested under this zoning code variance. PROPERTY FACTS/DESCRIPTION: The subject property is a 37,569 square foot non-conforming lot in the R40 Residential District with two front yards, the easterly boundary fronting on Old Salt Road (152.20' wide), and the westerly boundary fronting on Bay Avenue (75.01' wide). It is improved with a single-family dwelling, an in-ground accessory swimming pool and an accessory garage, as described on the 2/28/08 site plan prepared by Samuels & Steelman (referring to a survey prepared by Stanley J. Isaksen, Jr., Licensed Land Surveyor, dated January 30, 2003). Page 2 - June 16, 2008 ZBA # 6162 - T. and S. McLaughlin CTM 144'5'9.1 BASIS OF APPLICATION: Request for a Variance under Section 280-15, based on the Building Inspector's April 18, 2008 Notice of Disapproval concerning additions and alterations to a nonconforming accessory garage located in a front yard, rather than the code-required rear yard RELIEF REQUESTED: The applicant proposes to renovate an existing accessory garage with an outdoor shower to a one-car garage with storage containing a recreation room (with half bath), and a new second-story non- habitable storage loft and work room. No indoor bath]shower is permitted or proposed. The existing outdoor shower will remain as exists in a location outside of the building_. ADDITIONAL INFORMATION: At the public hearing on May 29, 2008, questions were raised about the habitability of the proposed accessory structure based on the proposed uses and the installation of a 5 ring septic system. The hearing was recessed so that the applicant's architect, Tom Samuels, could consult with the Building Department about possible changes in the Notice of Disapproval based upon revised plans, and also provide the Board of Appeals with information from the Department of Health confirming their requirement for the septic system. Upon resuming the hearing, Mr. Samuels submitted a letter dated May 29, 2008 from Permit Examiner Damon Rallis, in which he stated that no change in the original Notice of Disapproval (dated April 18, 2008) was required and that the half bath in this accessory pool storage building is permitted as of right. In addition, a copy of a 'Notice of Incomplete Application - Residential' from the Suffolk County Department of Health Services, Office of Waste Management dated Feb 29, 2008 was submitted which confirmed the requirements of the architect's proposed sanitary system for the garage/pool storage building. The Zoning Board of Appeals granted a variance (#5837) for the owner/applicant's in-ground swimming pool on March 9, 2006. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law .q267-b(3)(b)(3)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The existing accessory garage is heavily screened from view along Bay Avenue by a stockade fence and dense vegetation and is set back 180' +/- feet from the road. It is set back 47.3' from the southerly property line and 18.1' from the property line of the neighbor to the west. No Page 3 -June 16, 2008 ZBA # 6162 - T. and S. McLaughlin CTM 144-5-9.1 additions to the existing foot print will be made and the proposed second stow conforms to the 20' maximum allowable height. Accessory garages and pool storage buildings are common in the area. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because this property has two front yards and therefore the building cannot be placed in a conforming location. 3. Town Law §267'b(3)(b)(3). The variance granted herein is not substantial. No additions to the existing foot print will be made and the proposed second- stow in this accessory building conforms to the code limitation of 20 feet maximum allowable height. 4. Town Law §267-b(3)(b)(5). The difficulty has not been self-created, but is caused by the shape of the property which fronts on two streets. 5. Town Law ~267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage- storage building with addition (for pool-related activities), while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Oliva, and duly carried, to GRANT the variance as applied for, and shown on the site plan (revised 4/8/08 sheet 1) and plans and elevations (sheet 2), prepared by Samuels & Steelman, Architects, dated 2/29/06, subject to the following Conditions: 1. No heating system or indoor shower may be installed. 2. Only a window unit for air conditioning is permitted (on the ground floor). 3. The accessory structure may not be used for sleeping purposes. To insure the neighbors' visual privacy, evergreen screening at a minimum height of 5 feet, six feet apart adjacent to the south and west shall be planted and continuously maintained between this accessory building and the neighboring properties to the south and west (N/F Brickell and N/F Techet). The above conditions shall be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. PROPERTY FACTS/DESCRIPTION: The applicant's 37,569 square foot parcel has 75.O1 feet along the east side of Bay Avenue and 155.20 feet along the west side of Old Salt Road, Mattituck, The property is improved with a single-family, two-story dwelling and detached accessory garage, shown on the January 30, 2003 survey, updated November 16, 2005 by Stanley J. Isaksen, Jr. BASIS OF APPLICATION: Building Department's October 24, 2005 Noti;;e of Disapproval, citing Section 100- 33 in its denial of an application for a building permit to construct a proposed accessory swimming pool. The reason stated by the Building Inspector in the denial is that the pool construction is proposed in a front yard instead of the code-required rear yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 2, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, pemonal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTFD: The applicants wish to construct an in-ground swimming pool behind their dwelling, at 15 feet from the northerly side lot line and 165 feet from the front lot line along Bay Avenue. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The property has two front yards, one at Old Salt Road and the other at Bay Avenue. Although the existing home faces Old Salt Road, the rear boundary of the property fronts along Bay Avenue, making that a second front yard. Under the code definition of yard areas, the property has no rear yard designation. The yard requested for the pool location gives the appearance of the rear yard because it is behind the home and at least 165 feet from Bay Avenue. Grant of the requested relief Is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Here are the reasons we disagree with their proposed project. The proposed changes to the septic system would add an additional burden to the already fragile ecosystem of Salt Lake Village. A two-story building would obstruct views in the neighborhood. It would also change the character of Salt Lake Village, traditionally limited to one-story, cottages. From the drawSngs the McLaughlins have submitted, it is clear that they could easily make their garage habitable. They may be making it into a rental unit or an in-law apartment. The area is not zoned for multi-family properties. It would be very easy for the McLaaghlins to skirt the zoning restrictions by adding a toaster oven and hot plate. If they did move people into the garage, the living quarters would be too close to the border of our property. Additional inhabitants would also increase noise and traffic in the area. Even if no one moves into the garage, the plans call for adding dormers with windows and adding windows in the gable ends of the roof. The windows on the south-facing gable and the west-facing dormer would intrude on our privacy. In addition, because the gm'age is right next to our property, noise from windows in those locations would carry directly to our house. Even if they did not make the garage a habitable structure by adding a stove or hot plate, the structure could still be used as a type of dormitory, which would engender additional noise. Please include our written statement in your deliberations about this issue. Use the current owner name and addresses shown on the assessment rolls maintained by the Town Assessors' Office located at Southold Town Hall, or Real Property Office at the County Center, Riverhead. If you know of another address for a neighbor, you may want to send the notice to that address as well. If any letter is returned to you undeliverable, you are requested to make other attempts to obtain a mailing address or to deliver the letter to the current owner, to the best of your ability, and to confirm how arrangements were made in either a written statement, or during the hearing, providinq the returned letter to us as soon as possible; AND not later than May 13th: Please either mail or deliver to our office your Affidavit of Mailing (form enclosed) with parcel numbers, names and addresses noted, and furnish it to our office with the white receipts postmarked by the Post Office.
