SEqRA DETERMINATION: The Zoning Board of Appeals has visited the
property under consideration in this application and determines that thin
review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
LWRP EXEMPT: This application is exempt under Town Code LWRP
Chapter 268, inasmuch as no natural resource feature was found within 100
feet of the property.
PROPERTY DESCRIPTION: The applicant's property consists of
approximately six acres with 452.87 feet along Aldrich Lane.
BASIS OF APPLICATION: Request for a Variance under Sections 280-15E,
based on the Building Inspector's April 4, 2008 Notice of Disapproval
concerning accessory sports Hghting. The existing Sports Field with lighting
is shown on Diagram E'I prepared 1-7-08 by Ward Associates.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on
May 29, 2008 at which time written and oral evidence were presented. Based
upon all testimony, documentation, personal inspection of the property, and
other evidence, the Zoning Board ~nds the following facts to be true and
relevant:
AREA VARIANCE RELIEF REQUESTED: Requested is an area variance
concerning the height of lighting poles at an existing sports field, three of
which will be at 70 feet in height, and two at 80 feet in height.

REASONS FOR BOARD ACTION: On the basis of testimony presented,
materials submitted and personal inspections, the Board makes the following
1. Town Law §267-b(3)(b)(3)(1). Grant of relief win not produce an
undesirable change in the character on the neighborhood and a possible
detriment to nearby properties because the proposed five poles are replacing
eight poles that existed on this field until they were removed for safety
reasons.
2. Town Law §267-b(3)(b)(3)(2). The benefit sought by the applicant e~n~ot
be achieved by some method feasible for the applicant to pursue, other than
an area variance because the height of the poles (3 at 70 feet and 2 at 80 feet)
will allow for directing the lighting more efficiently to reduce light spill to
adjourning properties.
3. Town Law .~267-b(3)(b)(3)(3). The variance granted herein is substantial
representing more than 300% variance from the code required 18 feet.
4. Town Law .i267-b(3)(b)(3)(5). The alt~c~ty has not been self created
because lights have existed at this location for many years and the need to
upgrade them to a more efficient and dark sky compliant system dictates that
the poles be coustructed at the height proposed.
5. Town Law §267-b(3)(b)(3)(4). There has been no evidence submitted to
suggest that a variance in this residential neighborhood may have an adverse
impact on the physical or environmental conditions in the neighborhood.
6. The grant of the requested relief for the height of field lighting pole
is the mlnlm,m action necessary and adequate to enable the applicant to
enjoy the benefit of the sports field, while preserving and protecting the
neighborhood and the health, safety and welCsre of the cemm,mlty.
RESOLUTION OF THE BOARD: In considering all of the above factors and
applying the balancing test under New York Town Law 267-B, motion was
offered by Member Dinizlo, seconded by Member Weisman, and duly carried,
GRANT the vari~,~ce as applied for, with the condition that the
structures and lighting spe~i~cally be placed as described in Diagrams
identified as E-3 (dated 1-7-08), E2 and E4 Diagrams revised 4/16/08,

and shown on the 4-21-08 Ill-mlnstion Sheet, prepared by Ward
Associates.
Any deviation from the va~,~ce given such as extensions, or demolitions which are
not shown on the applio~,,t's &iAgrams or survey site maps, are not authorized under
this application when involving nonconformities under the zoning code. This action
does not authorize or condone any current or future use, setback or ether feature of
the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action
The Board reserves the right to substitute a eimilar design that is de minimls in
nature for an alteration that does not increase the degree of nonconformity.

REASONS FOR APPEAL (additional sheets may be used with preparer's signature):
AREA VARIANCE REASONS:
(1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a
detriment to nearby properties, if granted, because: 1) the proposed five poles are replacing eight poles of
essentially the same height which were removed for safety reasons. 2) the new lighting is considerably more
energy efficient and dark sky compliant. 3) the property is bounded by open space, cemetery, school athletic
fields, and open fields. The few houses in the area will be less impacted by this lighting than the prior lighting.
(2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant
to pursue, other than an area variance, because: sports lighting requires poles of this height. This field has
been used for baseball, soccer and other athletic facilities since 1980. The adjoining field owned by the
Mattituck-Cutchogue School District has been used as an athletic field since well prior to that date.
(3) The amount of relief requested is not substantial because: the poles are the same height as the prior
poles, but are safer, more efficient, and better engineered due to improved technology. The height limit of 18
feet was selected for solid buildings, accessory to principal buildings. The maximum diameter of the poles at
the base is 18 inches, so they will not present a bulky, looming appearance which the 18 foot Code limitation
was designed to avoid.
(4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions
in the neighborhood or district because: the usage is not changing. Further, the property is bounded on the
North by subdivision open space, on the East by farm fields, on the South by additional ball fields and a school
building, and on the West by a cemetery. The few homes in the area are some distance away and screened by
tree cover. Further, Park District regulations will limit the use of the lighting facilities to reasonable hours.

This is the MINIMUM that is necessary and adequate, and at the same time preserves and protects the
character of the neighborhood and the health, safety and welfare of the community.

existence since the late 1970$ serving the youth soccer needs o~ the
North Fork. The programs run by the clubs include children from ages 4
through l 7 and annual registrations total over 700 I>articipants from
Laurel, Mattituck, Cutcbogue, Peconic, $outhold, Greenport and other east
end communities.
We have been privileged to hold practice sessions a~d games on the
soccer fields located on Aldrich Lan~ in Laurel for many years, in recent
times, we have also had the ol~l~ortunity to use the new field on Rte. 48
(Strawberry Field) in Mattituck. Regarding ~he Aldrich Lane fields, we
were fortunate to conduct evening practice sessions there for many years
aa there was available built-in Ii~hting for'the area.
In a bad storm several years age, one of the light poles fell down and it
was determined that the other lighting unite had to be removed due to
gaiety concerns, Since that ti'me the club, Mattltuck Park District and town
officials have been diligently working to came up with a plan for
replacement lighting that would enable our organization, as well as other
local residents, to be able to safely use the ~ialds in the evening. A recent
vote bY the Mattituck Park District residents approved necessary funding
that, combined with monies set aside by the Town of S~u~hold several
years ago and a large grant from another legislative source, covers the
cost of purchase and installation.

The Planning Board received your request for comments regarding the above application to
construct five light poles for recreational lighting.
A major concern with sports lighting is light trespass onto neighboring properties, especially as it
relates to illuminating residential properties with unacceptably high levels of light, or causing
glare into oncoming traffic on nearby streets. Our initial review of this plan has revealed that the
neighboring residences are receiving a higher than acceptable level of direct light trespass.
The Planning Board recommends the applicant minimize the direct light trespass onto the
neighboring residential property to 0.1 footcandles or less. The lighting installation should be
designed to achieve no greater than the minimum illuminance levels for the activities as
recommended by the Illuminating Engineering Society of North America (IESNA). We also
recommend that the lighting be "dark-sky" friendly, meaning light spill above 90 degrees is
prevented.

Ladies/Gentlemen:
On behalf of the Mattituck Park District, we are submitting an application
for a height variance for five lighting poles for its proposed Aldrich Lane
Sports Lighting project on the Aldrich Lane Fields, Laurel, NY. Until
recently, the baseball field on the northeast portion of the property contained
eight light poles, approximately 70 to 80 feet in length, which were erected
many years ago. Due to safety considerations resulting from the rotting of the
wooden poles, they were removed. The Park District has been working on
obtaining funding and specifications for replacement of the lighting, and has
employed Ward Associates to design specifications for five illumination
poles, two of which are 80 feet in height and three of which are 70 feet in
height. These poles will illuminate the baseball field and, to some extent, the
soccer field. The main purpose of the lighting is to allow practices to
continue in the evenings as the teams are unable to practice during daylight
hours due to school schedules.
The specifications for the lights are Musco Green or equivalent. This
is the latest technology in the industry, and provides energy efficiency as well
as dark sky protections. The engineers will be able to provide details to you
on both of these issues.
Accordingly, we enclose the following papers, in seven sets, in
connection with the Notice of Disapproval:
1. Copy of Notice of Disapproval dated April 4, 2008;
2. Application to Southold Town Board of Appeals with consent from owner;
3. Questionnaire for Filing ZBA Application;
4. Transactional Disclosure Form;
5. Project Description and photos;
6. Copy of the tax map and Assessors Card;
7. LWRP Consistency Assessment Form;
8. Proposed plan for new lighting poles.
I have asked John Cushman, the Park District's Treasurer, to provide you with
the $150 fee for the application.
An engineer from Ward Associates will attend the hearing to review the
lighting issues in technical detail, and address the Dark Skies policy of the Town.
