THIS INDENTURE, made the /7~-- day of October, Two Thousand One
BETWEEN
DOROTHY SARGEANT, residing at 1155 Old Harbor Road, New Suffolk, New York 11956,
party of the first part, and
PALMER VICTORIA LTD., whose address is 455 Main Street, Greenport, New York 11944,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Incorporated Village of Greenport, Town of Southold,
County of Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point on the westerly side of Main Street distant 89.55 feet southerly from
the corner formed by the intersection of the westerly side of Main Street and the southerly side
of Center Street; '
RUNNING THENCE along the westerly side of Main Street South 7 degrees 01 minutes 40
seconds East 75 feet to land of Heffernan; ~
THENCE South 85 degrees 23 minutes 20 seconds West along said land 166.81 feet to lands
now or formerly of Urban;
THENCE along said land now or formerly of Urban, North 6 degrees 49 minutes 00 seconds
West 58.45 feet to a point;
THENCE still along said land now or formerly of Urban, North 7 degrees 00 minutes 50
seconds West 16.59 feet to land now or formerly of Angelson;
RUNNING THENCE along said land of Angelson and along land now or formerly of Reel
Land Corp., North 85 degrees 23 minutes 20 seconds East 166.61 feet to the westerly side of
Main Street at the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated August 3, 1987, and recorded August 7, 1987, in the Office of the Suffolk County
Clerk in Liber 10387, Page 1, and by deed dated October 10, 1996, and recorded December
19, 1996, in the Office of the Suffolk County Clerk in Liber 11806, Page 10.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
year first above written.
