consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected, situate,
lying and being in the Incorporated Village of Greenport, Town of Southold, County of Suffolk
and State of New York, more particularly bounded and described as follows:-
BEGINNING at a point on the easterly side of Fifth Avenue where the division line between the
premises herein described nnd the land now or formerly of Jaeger intersects said Avenue and
which said poinl is also distant 142.40 feet northerly as measuared along the easterly side of
Fifth Avenue Imm the comer formed by the inlersection ofthe said easterly side of Fifth Avenue
with the northerly side of Front Street;
RUNNING THENCE along the easterly side of Fifth Avenue, North 14 degrees 49 minutes East
50.50 feet to the other land now or formerly of Jaeger;
THENCE along said land of Jaeger, South 76 degrees 14 minutes East, 106.94 feet to the land
now or formerly of Ficurili;
THENCE along the said line of Ficurilli and land of Price, ~uth 14 degrees 51 minutes We~t,
50.50 feet to tho land of Jaeger;
THENCE along the land of Jaeger, North 76 degrees 14 minutes West, 106.91 feet lo the easterly
side of Fifth Avenue to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to Ihe party of the first part by
deed dated February 14, 1979, and recorded in the Suffolk County Clerk's Office on March 21,
1979, in Liber 9539 page 286.
RESERVING, HOWEVER, a legal life estnte in the above-described premises with the buildings
and improvements thereon erected, in and to the party of the first part,
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as she may choosc, to change her remainderman as
follows:
TO or among any one or more members of a class consisting of the pafly of the first part's
descendants, in any degree, whether presently living or bom hereafter, in such proportions and
amounts, without regard to equality, outright or in trust, as the party of thc first part may direct
and appoint during her lifetime by a properly written nnd acknowledged instrument, and
recorded prior to death, making specific reference to this power ofappointmcnt. Thc party of thc
first part may not appoint herself, her estate, her creditors or thc creditors of her estate, under any
circumstances.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and nil the estate and rights of the party of the first part in and to snid
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby thc said premises have been encumbered in nny way whatever, except as
aforesaid.
AND thc party of thc first part, in compliance with Section 13 of thc Lien Law, covenants that
the party of the first part will receive thc consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for thc purpose ofpaying the
cost of thc improvement and will apply the same first to thc payment of the cost of the
improvement before using any part ofthe total ofthe same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever thc sense of this indenture so
requires.
