Subject to reserving unto the parties of the first part, JACK Di GIORGIO and MURIEL Di GIORGIO a life estate. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof, TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises, TO HA VE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party 9fthe second part forever. AND the party of the first part, covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party oi'the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires. Town of Southold, Village of Laurel, County of Suffolk and State of New York, which said land is more particularly bounded and described as follows: BEGINNING at a monument on the boundary line between the land of Elizabeth M. Connors and Land of Piquet, said monument being one hundred (100) feet southerly as measured along the Easternly boundary line of land of Piquet from Great Peconic Bay Boulevard; from said point of beginning running along land of Connors, North 39 Degrees, 39 Minutes 10 Seconds East 97.96 feet to a monument and land of Patterson; thence along said land of Patterson, being also along the Easterly line of a 15 foot right of way, hereinafter described, South 17 degrees, 55 minutes, 30 seconds East 100 feet to land formerly of Connors; thence along land formerly of Cormors, South 39 degrees 39 minutes, 10 seconds West 97.96 feet to land of Piquet; thence along land of Piquet, North 17 degrees 55 minutes 30 seconds West 100 feet to point or place of Beginning. SUBJECT to an easement of an existing gas line which now serves Plot 3. In the event that said gas line proves to be an obstruction in the event of future construction on the above described property, then in that event the said gas line will be relocated at the expense of the party of the second part or his assigns. SUBJECT to and together with a right of way 15 feet wide from said Peconic Bay Boulevard southerly about 560 feet to Peconic Bay; the easterly line of said portion of the said right of way being the easterly boundary of said land herein conveyed and the Westerly line being parallel with the 15 feet westerly therefrom and crossing the hereinabove described premises, and the northerly and southerly boundaries of the said portion of the said right of way being extensions of the northerly and southerly boundaries of the parcel described in the preceding paragraphs. The portion of the said right of way herein conveyed is subject to the right and privilege of other owners of parcels of said land adjacent the right of way owned by the vender to use in common exclusive with other owners of such parcels, their tenants and invitees, the entire length and width of the said right of way as shown on aforesaid survey. BEING and intended to be part of the same premises conveyed to the Grantor herein by deed dated June 30, 1958 and recorded in the Suffolk County Clerk's Office on July 8, 1958 in Liber 4481 at page 515 of deeds. SUBJECT to any state of facts an accurate survey may show; covenants, restrictions, easements and reservations of record if any; building regulations and zoning ordinances of the local municipal authority.
