Baylis, C.E., Huntington, LJV, which map was filed in Suffolk County Clerk's Office on or about January 3rd, 1914 as #41, said Plot A being generally bounded and described as follows: BEGINNING at a point in the highwater line of Mattituck Bay at the southwesterly extremity of the premises hereby conveyed and the southeasterly extremity of lands formerly of Samuel B. Terry; RUNNING THENCE north 37 degrees 24' west, 460.59ths feet along said lands formerly of said Samuel B. Terry; THENCE north 36 degrees 40' west along other lands of said Hiram A. Baylis known as South Drive, 10 feet; RUNNING THENCE south 83 degrees 35' east 628.90ths feet to the highwater line of Mattituck Bay; and RUNNING THENCE southerly and westerly along the highwater line of said Bay, 504.40ths feet to the point or place of BEGINNING; excepting so much thereof as was heretofore conveyed to Mary C. Goddard by deed recorded in the Suffolk County Clerk's Office in Liber 966 of deeds at page 402 on the 24th day of July, 1918, being in Town of Southold, Suffolk County, N.Y. Also all the right of way, title and interest of the party of the first part in and to Mattituck Bay in front of the above premises and also a right of way to be used in connection with the property hereby deeded, over the private way known as South Drive and the private way known as Bay View Avenue, shown on said map to be a public highway. SAID premises known as and by 709 South Drive, Mattituck, New York as shown on the Suffolk County Land and Tax Map as District 1000, Section 10600, Block 1100, Lot 024000. GRANTOR herein being one and the same as Grantee in Deed dated September 8, 1982 and recorded October 21, 1982, in Liber 9259, page 139. SUBJECT TO a life estate hereby reserved by the grantor, DOROTHY M. NORTHRIDGE. SUBJECT TO the reservation of special power of appointment attached hereto as Exhibit A. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
