THIS INDENTURE, made the 3rd day of June, Two Thousand Two
BETWEEN
WILLIAM R. PELL, III and MARIAN B. PELL, husband and wife, residing at 210 Atlantic
Avenue, Greenport, New York 11944,
party of the first part, and
MARK PHILLIPS and MARY BESS PHILLIPS, husband and wife, residing at 215 Fourth
Street, Greenport, New York 11944,
party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part foi'ever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Incorporated Village of Greenport, Town of Southold,
County of Suffolk and State of New York, known and designated as Lot 95 and part of Lot 94
as shown on a certain map entitled, "Map of Sterling Manor Property of John Monsell", filed
in the Office of the Clerk of the County of Suffolk on 6/18/1873, as Map No. 53, being
bounded and described as follows:
BEGINNING at a monument set on the easterly side of Atlantic Avenue, distant 80.00 feet
southeast, as measured along the easterly side of Atlantic Avenue, from the corner formed by
the intersection of the easterly side of Atlantic Avenue and the southerly side of Monsell Place;
RUNNING THENCE North 72 degrees 26 minutes 20 seconds East, 156.18 feet;
THENCE along Sterling Creek and a tie'line, South 18 degrees 07 minutes 50 seconds East,
60.00 feet;
THENCE through Lot 94, South 72 degrees 26 minutes 20 seconds West, 156.79 feet to the
easterly side of Atlantic Avenue;
THENCE along said Road, North 17 degrees 33 minutes 00 seconds West, 60.00 feet to the
point of place of BEGINNING.
TOGETHER with all the right, title and interest of the party of the first part in and to the lands
under the water of Sterling Creek lying in front of and adjacent to the above-described
premises.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed from Frances Bishop, dated 5/25/78, and recorded 5/31/78, in the Office of the Suffolk
County Clerk in Liber 8436, Page 112, and a deed from Marian B. Pell, dated 9/30/97, and
recorded 10/20/97, in the Office of the Suffolk County Clerk in Liber 11857, Page 747.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of ihe Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
year first above written.
