THIS INDENTURE, made the day of May, nineteen hundred and ninety-eight

SUSAN M. MAGRINO, residing at 24 West 55th Street, Apt. 8N, New York, NY 10019; JANE
MAGRINO TOLMAN, residing at 620 Thomas Street #195, Key West, FL 33040; and ALLYN
MAGRINO HOLMBERG, residing at 177 Waverly Place, Apt. 4R, New York, NY 10014, as
residuary beneficiaries under the Last Will and Testament of Joseph L. Magrino, Jr. (Suffolk
County Surrogate's Court File No. 1406 P 1996)

JOSITA BARON, residing at 210 Stillwater Avenue, Cutchogue, NY 11935
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever, their
remaining undivided one-half interest in and to
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected,
situate, lying and being at Cutchogue, Town of Southold, County of Suffolk, and State of New
York, bounded and described as follows:-
BEGINNING at a point on the southwesterly line of Stillwater Avenue 160.00 feet southeasterly
along said southwesterly line from the Main Road, running along said southwesterly line from the
Main Road;
RUNNING THENCE along said southwesterly line of Stillwater Avenue, South 45 degrees 14
minutes 30 seconds East, 99.68 feet;
THENCE along land now or formerly of Bradley, South 42 degrees 20 minutes 10 seconds West,
204.23 feet to land now or formerly of Gildersleeve;
THENCE along land of Gildersleeve, North 45 degrees 34 minutes 20 seconds West, 40.90 feet;
THENCE North 46 degrees 32 minutes 20 seconds West, 50.09 feet to land now or formerly of
Baxter;

THENCE along said land now or formerly of Baxter, North 39 degrees 55 minutes 10 seconds
East, 206.19 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to Joseph L. Magrino, Jr. and
Josita Baron, as tenants in common, by deed dated April 2, 1993, and recorded in the Suffolk
County Clerk's Office on April 15, 1993, in Liber 11625 page 712.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof, TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
