WITNESSETH, that the party of thc first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or succe,~rs and assigns of the party of the second part forever,
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected,
situate, lying and being in the Incorporated Village of Greenport, Town of Southold, County of
Suffolk and State of New York. known and designated as and by parts of Lots 29 and 30 on a
certain map entitled, "Sterling Manor, Property of John A. Monsell" and filed in the Office of
the Clerk of the County of Suffolk on 6/18/73 as Map No. 53, and being bounded and
de~ribed as follows:-
BEGINNING at a l~int on ihe southerly side of Bridge Street distant 84.~ feet easterly from
the corner formed by the intersection of the southerly side of Bridge Street with the easterly
side of Sterling Place, which said point of beginning is the northeast corner of Lot 28 on said
map;
THENCE North 73 degrees 47 minutes East along the southerly side of Bridge Street, 84.86
feet to the northwest comer of Lot 31 on said map;
THENCE South 17 degrees 32 minutes 50 seconds East along the westerly side of Lot 31 on
said Map 73.39 feet;
THENCE South 73 degrees 07 minutes West 84.85 feet to the easterly side of Lot 28 on said
map;
~IENCE North 17 degrees 32 min6tes 40 seco/ids West along the easterly side of Lot 28,
74.39 feet to the southerly, side of Bridge Street at the point or plaee of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part
and Jess Lewis Owen by deed from Ruth ]VI. Preston dated Sepmmber 16, 1963, and recorded
in the Suffolk County Clerk's Office on September 17, 1963, in Libor 5416 page 286.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the
buildings and improvements thereon erected, in and to the party of the first part.
THE PARTY OF THE FIRST PART HEIt~nY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as ot~en as she may choose, to change her remainderman as
follows:
TO or among any one or more members of a class consisting of the party of the first part's
descendants, in any degree, whether presently living or bom hereafter, in such proportions and
amounts, without regard to equality, outright or in trust, as the party of the first part may
direct and appoint during her lifetime by a properly written and acknowledged instrument, and
recorcled prior to death, making specific reference to this power of appointment. The party of
the first part may not appoint herself, her estate, her creditors,or the creditors of her orate,
under any circumstances.
TOGETHER with all right, title and interest, ifany, of the party of the first part in and to any
streets and roads abutting the above described premises to thc center lines thereot~ TOGETHER
with the appurtenances and ail the estate and rights of' the party of the flint part in and to said
premises; TO HAVE AND TO HOLD thc premiscs heroin granted unto the party of' the second
part, thc heirs or successors and assigns of'thc party of tho sceond part forcvcr.
AND the party of'the first part covenants that the party oftbe first part has not done or suffered
anylhing whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for tho purpose ofpaying the
cost of. the improvement and will apply the same first to the payment of the cost of the
improvement before using any part ortho total ortho same for any other purpose.
Thc word "party" shall be construed as if it read "parties" whenever the sense ofthis indenture so
rcquires.
