THIS INDENTURE, made the 2"d day of November, Two Thousand Five

WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,

ALL that certain plot: piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Incorporated Village of Greenport, in the Town of
Southold, known and designated as part of Lot 53 on Map of Washington Heights, filed in the
Office of the Clerk of the County of Suffolk on 12/29/27 as File//651, said part of lot bcinl~
bounded and described as follows:
BEGINNING at a point on the southerly side of Washington Avenue distant 882.16 feet
westerly from the comer formed by the intersection of the westerly side of Main Street
(N.Y.S. Route 25) with the southerly side of Washington Avenue:
THENCE along the division line of Lots 53 and 54 on the above mentioned map, South 02
d. egrees 23 minutes 10 seconds East, 150.00 feet to land now or formerly of the Village of
Greenport;
THENCE along said land, South 87 degrees 36 minutes 50 g'conds West, 20.00 fect:
THENCE North 13 degrees 41 minutes 46 seconds West, 152.97 feet to the southerly side of
Washington Avenue;
THENCE along the southerly side of Washington Avenue, North 87 degrees 36 minutes 50
seconds East, 50.00 feet to thc point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed from Rudolph J. Dalder, Jr. and John E. Hurley dated 3/10/70, and recorded 4/6/70, in
the Office of the Suffolk County Clerk in Liber 6725, Page 34, and by deed from The Village
of Greenport dated 3/23/70, and recorded 4/6/70 in the Office of the Suffolk County Clerk in
Liber 6725, Page 32.
PARCEL II:
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Village of Greenport, Town of Southoid, County of
Suffolk and State of New York, bounded and described ns follows:
BEGINNING at a pipe on the southerly line of Washington Avenue, '932.16 feet westerly
along the southerly line of Washington Avenue fi-om its intersection with the westerly side of
Main Street (S.R. 25);
THENCE South 13 degrees 41 minutes 46 seconds East, 71.25 feet to a point;
THENCE through the land now or formerly of the Village of Greenport the following three (3)
courses and distances:
South 86 degrees 39 minutes 52 seconds West, 8.75 feet to a point;
North 13 degrees 32 minutes 33 seconds East, I 1.00 feet to a point;
North 10 degrees 17 minutes 01 seconds West, 60.00 feet to a pipe along the southerly
side of Washington Avenue and the point and place or BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed from the Incorporated Village of Greenpon dated September 23, 2005, and recorded
October 14, 2005, in the Office of the Suffolk County Clerk in Liber 12414, Page 495.
TOGETHER with all right, title and interest, if any, of the party of the f'tmt part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of thc first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except ns
aforesaid.
AND the party of the first part, in compliance with Section 13 of thc Lien taw, covenants that
the pat~ of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the pmlmse of paying the cost
of the improvement and will apply the same first to the payment of the cost of the impmvemem
before using any part of the total of the same for any other purpose.
The word 'party' shall b~ construed as if it read "pa~ies' whenever the sens~ of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first pa~t has duly executed this deed the day and year
