WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration
J paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
17 ALL that certain plot, piece or parcel of land. with the buildings and improvements thereon erected, situate,
lying and being imix at or near Mattituck, in the Town of Southold, Comity of Suffolk and
/p State of New York, bounded and described as follows:
bb BEGINNING at a concrete monument placed as a bound at a point in the southerly line of
a 30 foot right of way hereinafter described to indicate the northwest corner of land
about to be conveyed to H. Alvin Smith and Dorothy R. Smith, his wife; thence running
along the westerly line of said land about to be conveyed to H. Alvin Smith and .
Dorothy R. Smith, South 15 degrees 06 minutes 20 seconds East 972.76 feet more or less
to the waters of Great Peconic Bay; thence running along the waters of Great Peconic
Bay in a general southwesterly direction to the point of intersection of the south—
westerly corner of land herein conveyed and the southeasterly corner of land about to
be conveyed to H. Alvin Smith and Martin Suter; thence running along said last
mentioned land North 15 degrees 06 minutes 20 seconds West 933. 19 feet more or less to
a concrete monument placed as a bound at the point of intersection of the northwest
corner of land herein conveyed and the westerly terminus of the southerly side of the
aforementioned 30 foot right of way; thence running North 74 degrees, 53 minutes 40
seconds hast along the southerly side of said right of way 350 feet to the point or
place of beginning.
TOGETHER with all the right, title and interest of the party of the first part of, in
and to any land lying in Peconic Bay in front of said premises between the high and
low water marks.
TOGETHER with a right of way 30 feet in width, the southerly line of which is bounded
and described as follows: Beginning at a concrete monument placed as a bound at the
northwest corner of the parcel above described and running North 74 degrees 53
m=mutes 40 seconds East a distance of 350 feet to a concrete monument placed as a
bound at the point of intersection of the northeast corner of the parcel above
described and the northwest corner of said land about to be conveyed to said H. Alvin
Smith and Dorothy R. Smith; thence continuing on the same course along the said last
mentioned land a distance of 119. 14 feet to a concrete monument; and thence running
North 43 degrees 36 minutes 00 seconds East 114. 12 feet to a concrete monument placed
as a bound at the southerly terminus of the easterly line of a 50 foot right of way
hereinafter described. (See Schedule "A" continued . . attached hereto)
TOGETHER with all right, title and interest, if any. of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first parr in and to said premises; TO HAVE AND TO HOLD
the premises herein granted unto the party of the second part. the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to
the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" Shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the part}' of the first part has duly executed this deed the day and year first above
written.

AND, TOGETHER with a right of way 50 feet in width, the easterly line of which
is bounded and described as follows: Beginning at a concrete monument placed
as a boundat the point of intersection of the terminus of the southerly line
of the right of way above mentioned and the easterly line of the right of way
herein desribed; thence running North 28 degrees 33 minutes 30 seconds West
601 .45 feet; thence North 8 degrees 37 minutes 00 seconds West 914.76 feet to
the south line of New Suffolk Avenue.
All of the above as shown on a map made by Otto Van Tuyl & Son, licensed
surveyors, dated March 20, 1951 and attached for recording to a deed of even
date herewith made by the party of the first part to himself and Dorothy R.
Smith, his wife, conveying the land mentioned (but not described) in the above
description and shown on said map as containing 10.40 acres.
AND TOGETHER with an easement over the said land about to be conveyed by deed
of even date herewith to the party of the first part and to Martin Suter to the
electric power and telephone lines on said land about to be conveyed to Smith
and. Suter as shown on said map.
SAID premises known as and by Harbor Farms, Mattituck, NY.
BEING AND INTENDED to be the same premises conveyed to the party of the first
part by deed dated April 13, 1951 , and recorded in the Suffolk County Clerk's
Office on April 19, 1951 , :in Liber 3205, Page 337.
