CHARLES W. EDWARDS and SARAH LEE EDWARDS, husband and wife, both residing at
625 Third Street, Greenport, New York
party of the first.part, and
CHARLES A. EDWARDS, residing at 139 Sterling Avenue, Greenport, NY 11944;
DAVID O. EDWARDS, residing at 9 Rolling Hills Drive, Ridge, NY 11961;
SHARON L. EDWARDS, residing at 16115 McConnell Drive, Upper Marlboro, MD 20772;
CHARLENE EDWARDS, residing at 4835 W. Braddock Road, Apt. 30, Alexandria, VA 22311;
JEAN D. EDWARDS, residing at 625 Third Street, Greenport, NY 11944
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected~
situate, lying and being in the Village of Greenport, town of Southold, County of Suffolk and
State of New York, bounded and described as follows:-
BEGINNING at the northwesterly comer of other land of Edwards, said point being the
following two courses from the intersection of the southerly line of Johnson Court and the
westerly line of Third Street: (1) South 83 degrees 10 minutes West 100.0 feet; thence (2)
South 6 degrees 50 minutes East, 150.0 feet to said point of beginning; and from said point of
beginning
RUNNING THENCE along said other land of Edwards, South 6 degrees 50 minutes East,
75.0 feet to the southwesterly comer of said other land;
THENCE along other land now or formerly of Village of Greenport, three courses: (1) South
83 degrees 10 minutes West, 140.0 feet; thence (2) North 6 degrees 50 minutes West, 75.0
feet; thence (3) North 83 degrees 10 minutes East, 140.0 feet to the point of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed from Village of Greenport, dated January 16, 1985, and recorded in the Suffolk County
Clerk's Office on May 13, 1985, in Liber 9789 page 341.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the
buildings and improvements thereon erected, in and to the party of the first part.
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as they may choose, to change their remainderman as
follows:
TO or among any one or more members of a class consisting of the party of the first part's
descendants, in any degree, whether presently living or born hereafter, in such proportions and
amounts, without regard to equality, 'outright or in trust, as the party of the first part may
direct and appoint during their lifetime by a properly written and acknowledged instrument,
and recorded prior to death, making specific reference to this power of appointment. The
party of the first part may not appoint themselves, their estates, their creditors or the creditors
of their estate, under any circumstances.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereoi~ TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and aSsigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year
first above written.
