WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of thc second part, docs hereby grant and release unto the patty
of the second part, the heirs or successors and assigns of the party of the second pan forever,
ALL that certain plot, piece or parcel of land, situate, lying and being in the Village of
Grecnpon, Town of Southold, Suffolk County, New York, being bounded and described as
follows:
BEGINNING at a point on the westerly side of Third Street, which point is distant 50.00 feet
southerly as measured along the said westerly side of Third Street from the corner formed by the
intersection of the southerly side of Johnson Court with the said westerly side of Third Street;
THENCE along thc said westerly side of Third Street, South 06 degrees 50 minutes East, 50.00
feet to land now or formerly of Lane;
THENCE along said land, South 83 degrees 10 minutes West, 140.00 feet to land now or
formerly of the Village of Greenpon:
THENCE along said land, North 06 dcgrees 50 minutes West, 50.00 feet to the land now or
formerly of Michalak;
THENCE along said land and along land now or formerly of BunSn, North 83 degrees 10
minutes .Fast, 140.00 feet to the westerly side of Third Street at thc point or place of
BEGINNING.
BEII~G AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated June 19, 2002, and recorded August 7, 2002, in the Office of Ihe Suffolk County
Clerk in Liber 12201, Page ?!1, and by Correction Deed dated November 26, 2002, and
recorded January 3, 2003 in the Office ortho Suffolk County Clerk in Liber 12228, Pager 232.
TOGETHER with all right, title and interesl, it' any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and ali the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party oflhe second
part, the heirs or successors and assigns of the party of the sccond part forever.
AND thc party of thc first part covenants that the party of thc first part has not done or suffcred
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose ofpaying the
cost of the improvement nnd will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
Thc word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
