THIS INDENTURE, made this /7 day of October, nineteen hundred and ninety-eight

WITNESSETH, that the parry of the first part, in consideration of ten dollars and other valuable consideration paid by the
party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns
of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being
at or near Mattituck, in the Town of Southold, County of Suffolk and State of New York, bounded and described as
follows:
BEGINNING at an iron pipe placed as a bound at the northwesterly corner hereof at a point in the center line of a private
20 foot right of way where same is intersected by the division line between the premises described herein and the southerly
line of lands conveyed by H. Alvin Smith and Dorothy R. Smith, his wife, to Einar B. Paust and Mary Ellen Paust, his
wife, by deed dated 8/24/62 and recorded 8/28/62 in Liber 5222 cp 28 said lands more recently being now or formerly
lands of Fred G. Moritt and Rosemary Skye Moritt, and from said point of beginning;
RUNNING THENCE along the center line of said 20 foot right of way the following two courses and distances:
(1) South 4 degrees 20 minutes 00 seconds West 120 feet; thence
(2) South 0 degrees 30 minutes 00 seconds East 60 feet;
RUNNING THENCE North 87 degrees 58 minutes 00 seconds East 1.97.11 feet to the mean high water line of Hall's
Harbor;
RUNNING THENCE along the mean high water line of Hall's Harbor the following 3 tie line courses and distances:
(1) North 10 degrees 41 minutes 40 seconds East 77.95 feet; thence
(2) North 29 degrees 10 minutes 10 seconds East 24.87 feet;
(3) North 1 degrees 23 minutes 50 seconds East 72.51 feet;
RUNNING THENCE North 89 degrees 30 minutes 30 seconds West along the division line first above-mentioned 216.81
feet to the point or place of BEGINNING.
TOGETHER with an easement for ingress and egress to and from the northwesterly corner of the above described
premises and the ordinary highwater mark of Great Peconic Bay over a right of way twenty (20)feet wide more particulary

RUNNING THENCE along the northerly side of the herein described right of way twenty (20) feet wide the following

(1) South 51 degrees 01 minutes 10 seconds East 17.26 feet;
(2) South 62 degrees 32 minutes 50 seconds East 69.37 feet;
(3) South 51 degrees 45 minutes 40 seconds East 26.85 feet to an iron pipe.
THENCE along the center of line of the herein described twenty (20) foot right of way the following five (5) courses and
distances:
(1) South 0 degrees 38 minutes 50 seconds West 122 feet;
(2) South 4 degrees 20 minutes 00 seconds West 120 feet;
(3) South 0 degrees 30 minutes 00 seconds East 120 feet;
(4) South 6 degrees 05 minutes 30 seconds East 195.63 feet;
(5) South 15 degrees 06 minutes 20 seconds East 195 feet more or less to the ordinary highwater mark of Peconic
Bay;
TOGETHER with an easement for ingress and egress to and from New Suffolk Avenue and the w--*-.iy terminus of the
above-described twenty (20) foot right of way over a right of way fifty (50) feet wide for all ordinary purposes.
TOGETHER with all right, title and interest, if any, of the parry of the first part in and to lands under the waters of Hall's
Creek.
SUBJECT TO the burdens and together with the benefits of all covenants, restrictions, easements of rights of way,
agreements, reservations and zoning regulations of record, if any, affecting the said premises.
BEING AND INTENDED TO BE the same premises described in the deed of the parties of the first part herein by deed
from FRED G. MORITT and ROSEMARY SKYE MORITT, his wife, dated 2/3/82, recorded in the Suffolk County
Clerk's Office on 2/5/82, in Liber 9139, Page 307.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any sf10Vs1%ffl&dds abutting

TOGETHER with the appurtenances, and also all the estate and rights of the party of the first part in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said
premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part
will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to
be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the
cost of improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above written.
