R.A., specifically Item #3, the property owner should be informed that in
accordance with Chapter 275 - Wetlands & Shoreline of the Town Code, 275-5
Permit procedures - A. Permit required. Notwithstanding any prior course of
conduct or permission granted, no person shall conduct operations on any area
within Trustee jurisdiction (275-3C) without first obtaining a written permit therefor
issued by the Trustees as hereinafter provided and only while such permit
remains in effect.

Dear Mr. Sidor:
As per a request from your office, I have reviewed the Site Plan, dated 6/18/10
for the proposed Lot Line Change on a residential lot in the R-80 Zoning District.
Please consider the following:
1. This requested Lot Line Change meets the minimum requirements listed in
the definition of a Minor Action (HH) under Town Code Chapter 268 - Waterfront
Consistency Review.
2. Survey Monuments should be required at the following locations along the
new Property Line.
a. Adjacent to the ROW along Paradise Point Road,
b. At the change of alignment in the new Property Line, and;
c. At the Top of Bluff / Bank as indicated on the site plan.
3. Who will maintain ownership of the Dock and Boathouse? If lot # 2 is to
retain access to these facilities, the Planning Board should establish a C&R to
record the access / easement.
4. This proposed action does not appear to violate any sections of Town Code
and therefore is recommended for approval.

TERMS AND CONDITIONS

the consideration for the issuance of the Penuit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittea
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is Valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Pennittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization :was originally obtained.
4. TI~ the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the fight of the public to pass and repass along the
beach between high a~.,~d low water marks.
That if future operations of the Town of Southold require the remoVal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittea will be
required, up°n due notice, to remove or alter this work project herein stated without
expanses to the Town of Southold.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittec will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

The Board of Town Trustees took the following action during its regular meeting held on
Wed., November 19, 2008 regarding the above matter:.
WHEREAS, Richard Henry Behr Architect P.C. on behalf of CHARLES & AMY
SCHARF applied to the Southold Town Trustees for a permit under the provisions of
Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of
Southold, application dated October 20, 2008, and,
WHEREAS, said application was refen'ed to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, in accordance with Chapter 268, said application was found to be Exempt
from the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on November 19, 2008, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board membem have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of CHARLES & AMY
SCHARF to renovate the existing 362 sf. boat house and 206 sf. bath house, and as
depicted on the plans prepared by Richard Henry Behr Amhitect, P.C. last revised
November 14, 2008.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town
Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided
on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our
recommendation that the proposed action is EXEMPT pursuant to § 268-3; provided that there are no substantial
changes to the existing structures.

This application covers the renovation to existing accessory buildings on the site. Both
buildings, known as "Bath House" (+ 206 SF) and "Boat House" (_+ 362 SF) currently exist within
the buffer required for a tidal wetland by the New York State Department of Environmental
Conservation (DEC). Proposed work includes the selective removal of rotted building
components, installation of hurricane ties in selected locations, removal of hot water facilities in
the Bath House, and renovation of roof and siding materials. There are no changes to the site
proposed under this application. Generally, construction materials will include: wood framing,
cedar and asphalt shingles, and painted wood trim.
The intention of the applicant in proposing this work is to improve the appearance and
serviceability of the existing buildings. The work described is expected to commence in
November 2008, proceed through February 2009, and is not anticipated to adversely affect the
character of the existing tidal wetland. All material storage will be contained on the landward
side of the existing building. Appropriate erosion control measures will be utilized to minimize
deterioration of the existing embankmenL

the above described work to the existing buildings.

the buffer required for a tidal wetland by the New York State Department of Environmental
Conservation (DEC). Proposed work includes the selective removal of rotted building
components, installation of hurricane ties in selected locations, removal of hot water facilities in
the Bath House, and renovation of roof and siding materials. There are no changes to the site
proposed under this application. Generally, construction materials will include: wood framing,
cedar and asphalt shingles, and painted wood trim.
The intention of the applicant in proposing this work is to improve the appearance and
serviceability of the existing buildings. The work described is expected to commence in
November 2008, proceed through February 2009, and is not anticipated to adversely affect the
character of the existing tidal wetland. All material storage will be contained on the landward
side of the existing building. Appropriate erosion control measures will be utilized to minimize
deterioration of the existing embankment.
The applicant respectfully requests a Wetland Permit from the Board of Trustees to complete
the above described work to the existing buildings.
