THIS INDENTURE, made the 27t~ day of July, Two Thousand Four

party of the first part, and
PETER ERNEST FLEISSIG, residing at 2899 Iroquois Road, Memphis, Tennessee 3811 I,
party of the second part,
WITNESSETH~ that the party of the first part, in considerntion ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL thnt certain plot, piece or parcel of land, situate, lying and being in the Incorporated Village
of Greenpon, Town of Southold, County of Suffolk and Slate of New York, bounded and
described as follows:
BEGINNING at a point on the northerly side of Broad SLeet distant westerly 93.69 feet as
measured along the same from the intersection of the northerly side of Broad Street with the
westerly side of Main Street;
RUNNING THENCE along the northerly side of Broad Street South 83 degrees 06 minutes 40'
seconds West 77.69 feet to land now or formerly of Clauclio;
RUNNING THENCE along said lands Nor~ 10 degrees 30 minutes 53 seconds West 99.82 feet
to land now or formerly of Fry;
RUNNING THENCE along said lands North 83 degrees 24 minutes 00 seconds East $6.27 feet
to land now or formerly of Jackson;
RUNNING THENCE along said lands South 22 degrees 29 minutes 19 seconds East 103.13 feet
to the northerly side of Broad Street at the point or place of BEGINNING.
BEING AND INTENDED TO BE the same pren~ises conveyed to Marie C. McMann by deed
from Frank J. McMunn, dalmt 9/11/61 and recorded 9/14/61 in the Office of the Suffolk
County C~erk in tiber 5048, Page 303.
TOGETHER with all righi, title and int.-rest, it' any, o1' the party of'the lust pa~ in and to any
· streets and roads abutting the above described premises to the c~ter lines thergof; TOGETHER
with the appum:nsnces and all the estate and rights of the pa~y ot- the first pan in and to said
premises; TO HAVE AND TO HOLD the premises herein ~ranted unto the party of the second
pa~. the heirs or successors and assigns ofthe party of the second part f'orever.
AND the pat~y of the first part covenants that the party ofthe first part has not done or suffered
anything whoreby the said premises have been oncumbered in any way whatever, except as
aforesaid.
AND the party ofthe first pa~ in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the considerntlon for this conveyance and will hold the
right to receive such consideration as n trust fund to he applied first for the purpose of paying the
cost of the improvement and will apply the same f~rst to the payment of the cost of the
improvement before using uny part of the total ofthe same for any other purpose.
The word "party" shall be construed as il'it read 'parties" whenever the sense of this indenture so
requires,
