That there will be no unreasonable interference with navigation as a result of the work herein authorized. As a result of discussions with the New York State Depmhaent of Environmental Conservation, however, the applicant has also agreed to modify the plan to employ the use of coif fiber rolls, sand fill, and native plantings at the toe of the bank in lieu of the previously proposed stone dp-rap approved by the Board of Trustees. Although the physical scope of the project remains unchanged while its composition is Iransformed from a "hard" to "soft' stabilization approach, I am unsure whether the Board can simply issue the permit reflecting this change or if you would need Io reopen the public heating to consider and approve the change or perhaps issue an administrative amendment therefor. SCTM#63-7-31.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the following LWRP policies and therefore is INCONSISTENT with the LWRP. The LWRP sub-policies below recommend the use of non-structural erosion control measures in restoring the natural protective features which have a reasonable probability of managing erosion. It is further recommended that an indigenous vegetative planting plan be implemented in place of the proposed action of approx. 175 linear ft. of 25 to 150 lb. stone rip-rap. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. B. Use vegetative non-structural measures to manage flooding and erosion hazards. 1. Use vegetative non-structural measures which have a reasonable probability of managing flooding and erosion, based on shoreline characteristics including exposure, geometry, and sediment composition. 2. Use vegetative measures to increase protective capabilities of natural protective features. Discourage clearing of existing, particularly indigenous vegetation during siting, design, construction and regrading phases of any 4.2 Protect and restore natural protective features. B.
