BETWEEN
KLEMENTYNA PILESKI, as surviving tenant by the entirety of Frank Pileski, who died a resident of
Suffolk County on July 22, 2008, residing at 905 Bayer Road, Mattituck, New York 11952, party of
the first part, and
THOMAS PILESKI as Trustee under the KLEMENTYNA PILESKI FAMILY TRUST, residing at
1250 Elijah Lane, Cutchogue, New York 11935, party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten and 00/100--($10.00)--dollars, and other
good and valuable consideration paid by the party of the second part, does hereby grant and release unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land with the buildings and improvements thereon erected, situate,
lying and being in the Town of Southold, at Mattituck, County of Suffolk and State of New York, being
known as Lot No. 45 on a certain map entitled "Map of Mattituck Heights", filed in the Office of the
Clerk of the County of Suffolk on March 25, 1927 as Map No. 192, said lot being bounded and
described as follows:
BEGINNING at a point on the westerly side of Bayer Road, said point being distant 150 feet
northerly from the corner formed by the intersection of the northerly side of Grant BIvd and the
westerly side of Bayer Road; Thence from said point of beginning Nodh 58 degrees 55 minutes 30
seconds West, 150 feet to a point; Thence North 31 degrees 4 minutes 30 seconds East, 50.00 feet
to a point; Thence South 58 degrees 55 minutes 30 seconds East, 150.00 feet to the westerly side
of Bayer Road; Thence along the westerly side of Bayer Road South 31 degrees 4 minutes 30
seconds West, 50.00 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed
dated May 1, 1995 and recorded in the office of the Clerk of the County of Suffolk May 9, 1995 in
Liber 11724at Page 67.1.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
~remises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
