WITNESSETH, that the party of the first pa~ to whom l~ers teslamenlary were issued by the
Surrogate's Court. Suffolk County. New York on November 22, 2002 and by virtue of the power and
authority given in and by said last will and ~tament and/or by Article 11 of the Estates, Powers and
Trusts Law, and in consideration of $325,000.00 dollars, pa~d by the party of the second pm, does
hereby grant and release unto the party of the second pan, the dislributees or successors and assigns of'
the party of tho second part fomvcr,
ALL that certain plot, piece or parcel of land with the buildings and impmvemenls thereon erected,
situate, lying and being in the Village of Greenport. Town of Southold, Suffolk County, New York,
bounded and described as follows:
BEGINNING at a point on the easterly side of 2"a Street distant 200.00 feet southerly as measured along
the easterly side of 2~d Street fi~om the comer formed by the intersection ofthe easterly side of 2'"' Street
and the southerly side of Broad Street;
THENCE North 83 degrees 34 minutes 20 seconds East along land now or formerly of Decia C. Fates,
150.19 feet to the land now or formerly of Randers J. Ireland;
THENCE South 06 degrees 48 minutes 00 seconds East along thc last mentioned land 50.91 feet to land
now or formerly of'Herbert L. and Betty J. Kalin;
THENCE South 83 degrees 13 minutes 00 seconds West along the last mentioned land 150.20 feet to
the easterly side of 2~ Street;
THENCE North 06 degrees 47 minutes 10 seconds West along thc easterly side of 2nd Slrect 51.84 feet
to the point or place of BEGINNING.
BEING AND INTENDED TO BE thc same premises conveyed to Alton T. Klipp and Joyce H. Klipp,
his wife, by deed from James H. Hansan, dated July 25. 1953, and recorded July 28, 1953, in the Office
of the Suffolk County Clerk in Liber 3553, Page 171
TOGETHER with all right, title and interest, if any, of the party of the first pm in and to any streets
and roads abutting the above described premises to the center line thereof,
TOGETHER with the appurtenances, and also the estate which thc said decedent had at thc time of
decedent's death in said preraises, and also thc mate therein, which the party of the first pan has OF has
the power to convey or dispose of, whether individually, or by virtue of said will or othet~vise,
TO HAVE AND TO HOLD the pmnises herein granted unto the party of the second pan, thc
distribotees OF successors and assigns of the party of the second part forever.
AND the party ofthc first part covenants that the potty of the first pail has not done or suffered anything
whereby thc said I~emises have been incumbered in any way whatever, except as aforesaid.
AND the party ofthe first part, in compliance with Section 13 of the Lien Law, covenants that the party
ofthe tim part will receive the consideration for this conveyance and will hold the right to receive such
consideration ns a trust fund to be applied first for the purposa of paying the cost of improvement and
will apply same first to the l~yment of the cost ofimprovemant before using any part of the total of the
same for any other purpose.
The word "pan'y" ~hail be construed as if it reads "parties' whenever ~ sense of this indenture so
requires.
