THIS INDENTURE, made the 17th day of July, Two Thousand One
BETWEEN
ROBERT F. SPITZENBERG and IRENE SPITZENBERG, his wife, residing at 375 Elizabeth
Lane, Southold, New York 11971,
party of the first part, and
ROBERT FRANK SPITZENBERG, JR., residing at 344 Terry Court, Southold, New York
11971
party of the second part, .
WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or pamel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, Suffolk County, New York, known
and distinguished as Lot 98A on a map entitled "Map Showing Alteration & Addition to
Founders Estates, situate at Southold, Suffolk Co., N.Y.", made by Otto W. Van Tuyl, dated
February 25, 1935 and filed in Office of the Clerk of Suffolk County on March 25, 1935, as Map
No. 1178; the said lot being bounded westerly by Old Shipyard Road, northerly by Lot 97A,
easterly by Lot C, southerly by Lot 99, and measuring seventy-five (75) feet on the westerly and
easterly boundaries and one hundred eighty (180) feet on the northerly and southerly boundaries.
SUBJECT to covenants and restrictions of record, if any, affecting said premises; and subject
also to zoning restrictions and ordinances adopted by any municipal, town, village or other
governmental authority.
TOGETHER with all the right, title and interest of the party of the first part in and to that portion
of Old Shipyard Road lying in front of and adjacent to the lands and premises above described to
the center line thereof.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated February 18, 1998, and recorded February 19, 1998, in the Office of the Suffolk
County Clerk, in Liber 11879, Page 111.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with file appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
