certain map entitled "Subdivision Map of Founders Estates, situate at
Southold, Suffolk County, New York, made by Otto W. Van Tuyl, Engineer
and Surveyor," dated March 18, 1927 and filed in the Office of the
Clerk of the County of Suffolk on May 10, 1927 as Map No. 834.
Together with all the right, title and interest of the parties of the
first part, if any, in and to that portion of Old Shipyard Road
lying in front of and adjacent to the premises above described and to
the center line thereof·
SUBJECT to covenants and restrictions of record, if any, affecting said
premises, and subject also to zoning restrictions and ordinances adopted
by any municipal, town, village or other governmental authority.
SUBJECT also to the restriction that only a one dwelling hourse shall be
erected on said lot. This is a covenant running with the land.
SUBJECT to such state of facts a more accurate survey may show or a
personal inspection thereof may disclose·
Being and intended to be the premises conveyed to Grantor by Deed
dated 4/16/55, recorded 4/25/55 in Liber 3874, Page 139·
Premises known as 645 Old Shipyard Road, Southold, NY
TOGETHER with all right, title and interest, if any, ~ the party ~ the fir~ part, in and to any stre~s and roads
abutting the above described premises to the center lines there.; TOGETHER with the appurtenances, and
also all the e~ate which the said decedent had at the time of decedent's death in said premises, and also the
estate therein, which the party of the fir~ part has or has power to convey or dispose of, whether individually,
or by virtue of said will or othe~ise; TO HAVE AND TO HOLD the promises herein gren~d unto the party ~
the second part, the heirs or su~essors and assigns of the party of the second part ~rever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
