PAUL J. TORPEY, residing at 3650 Bayshore Road, Greanport, New York 11944,
party of the second
WITNESSETH, that tho party of the first part, in eonsidemion ofTe~ Dolhus and othe~ valuable
consideration paid by the party of the second part,, does hereby grant and release unto the party
ofthe sccond part, the hcir~ or successors and assigns~of the pa~y ofthe sccond pan forcvcr,
ALL that certain plot, piece or parcel of land, with the buildin~ and improvements thereon
erected, situate, lying and being at Arsimmomoque, Town of Southoid, County of Suffolk and
State of New York, bounded and described as follows:
BEGINNING at a stake on the southerly side of a Privnl~ Road known as "Island View Lane,"
disnnt 20 feet westerly from n monun~nt thereon wher~ it is intersected by the westerly side
of land now or formerly of Velie;
RUNNING THENCE South 04 degrees 19 minutes 30 seconds West, 251.25 feet to a stake;
RUNNING THENCE South 47 degrees 35 minutes 00 seconds West, 113.59 feet to the mean
high water mark of the Creek;
RUNNING THENCE northwesterly along said mean high ~'mark on a tie line bearing
North 28 degrees 18 minutes 20 seconds West, a fie distance of 109.30 feet to the so~thoaslerly
side of land now or formerly of Susan Horn Muiholland Living Trust;
RUNNING THENCE along _~id_ land (1) North 23 degrees 31 minutes 00 seconds East,
105.80 feet; and (2) North 04 degrees 19 minutes 30 seconds East, 142 feet to the southerly
side of Island View Lane; and
RUNNING THENCE So~th 85 de~rees 40 minutes 30 seconds East along the southerly side of
Island View Lane, 102 feet to the point or place of BEGINNING.
TOGETHER with an easement OF right of way over Island View Jane for access to and from
Bayshore Road and to Pcconic Bay.
TOGETHER with a right of way being a triangu~rc~l., of land now used as a driveway and
described as follows:
BEGINNING at the northeasterly comer of the premises hereinabove described and running
ens~ly along Island View Lane, 10 feet;
RUNNING THENCE southwesterly 46 feet, more or less, to the easterly line of the premises;
RUNNING THENCE northerly along said easterly linc, 45 feet to the point of BEGINNING.
BEING AND INTENDED TO BE lhe same pr~nises conveyed m the party of the first part by
deed from G. David Young, as the duly appointed Guardian of the person and property of
Esther Y. Morcombe, dated July 1, 2003, and r~-corded on 8/1/03 in the Ofrx:e of the Suffolk
County Clerk in Liber 12264, Page 446.
TOGETHER with all fight, title and interest, if any, of the party of the first pat in and to any
streets and roads abutting thc above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the astute and rights of the party of the first part in and to said
premise~; TO HAVE AND TO HOLD the premises herein granted unto the party ofthe second
part, thc heirs or successors and assigns ofthe party of the second piti forever.
AND the party of the first part covenants that the party ortho first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party ofthe first pan, in compliance with Section 13 of the Lien Law, covenants that
the party of' the first part will receive the consideration for this conveyance ~nd will hold the
right to ~ceive such consideration as a trust fund to be applied first for tho purpose of payin8 the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part oftbe total of thc same for any .other purpose.
The word "party" shall be consh'ued as if it read "parties" whenever the sense of this indenture so
requires.
