WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being bWW at Mattituck, Town of Southold, County of Suffolk, and State
of New York, bounded and described as follows:
BEGINNING at the northwesterly corner thereof at the point of intersection of
the easterly side of Walnut Avenue, (a private road 34 feet, more or less,
wide which leads southerly from Sound Avenue) with the southerly line of land
of Ada Williams (said point of beginning being distant 250 feet, more or less,
from the southerly side of Sound Avenue) ;
RUNNING THENCE North 72 degrees 51 minutes 40 seconds East along the southerly
line of said land of Ada Williams 156.42 feet to the westerly line of land
belonging to L.I. Produce and Fertilizer Co. , Inc. ;
THENCE South 31 degrees 33 minutes 40 seconds East along the westerly line of
land last mentioned 142. 94 feet to a monument set in the northerly line of
land of Joseph Ruthnowski and Beller Ruthnowski;
THENCE South 75 degrees 23 minutes 10 seconds West along the northerly line
of land last mentioned 1.91.52 feet to a monument set in the easterly side of
Walnut Avenue;
THENCE North 17 degrees 26 minutes 20 seconds West along the easterly side of
Walnut Avenue 130 feet to the point or place of BEGINNING.
TOGETHER with all the right, title and interest, if any, of the parties of the
first part of, in and to Walnut Avenue lying in front of and adjoining the
above described premises on the west to the center line thereof, including an
easement for ingress and. egress over and upon said Walnut Avenue for its entire
length and width as it leads southerly from Sound Avenue.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first
part by deed from Edward S. Moisa and Celia M. Mosia, ux, dated July 7, 1962,
recorded 7/16/62 in Liber 5197, page 287, Suffolk County Clerk's Office.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
