bounded and described as follows: BEGINNING at the comer formed by the intersection of the
westerly side of Locust Avenue and the northerly side of Kom Road (50 foot wide right of way);
THENCE from said point of beginning, along the northerly side of Korn Road, South 73 degrees 11
minutes 00 seconds West, 105.96 feet to a point; TH ENC E North 17 degrees 10 minutes 10 seconds
West thru lots 24 and 25 on aforementioned map, 99.78 feet to the division line between lots 25 and
26 on said map; THENCE along said division line, North 7 degrees 21 minutes 50 seconds East, 96.91
feet to the westerly side of Locust Avenue; THENCE along the westerly side of Locust Avenue, South
22 degrees 21 minutes 20 seconds East, 100.00 feet to the point or place of BEGINNING.'
SAID premises being commonly known as 240 Locust Avenue, Southold, New York.
BEING AND INTENDED TO BE the same premises as those conveyed to the grantor herein bydeed
dated February 2, 2001 and recorded in the Suffolk County Clerk's Office on March 5, 2001 in Liber
12105 at page 953,
TOGETHER with all dght, tille and interest, if any, of the party o! the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of th~ second
part forever, ~
AND the party of the fimt part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for lhe purpose of paying the cosl of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
