AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that..the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consider- ation as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires. IN PRESENCE OF: Schedule A Description 500 Tarpon Drive, Southold NY, SCTM #1000-57-1-5 ALL that certain plot, piece or parcel of land situate, lying and being in the Town of $outhold, County of Suffolk and State of New York, known and designated as Lot No. 41 as shown on a certain map entitled, "Map of Southold Shores of Arshamomoque, Town of Southold, Suffolk County, New York" made by Otto W. Van Tuyl and Son, licensed land surveyors, Greenport, N.Y. dated July 1, 1963 and filed in the Office of the County Clerk of Suffolk County, New York on August 29, 1963 as Map No. 3853. BEGINNING at a point on the Southerly side of Tarpon Drive distant 340.00 feet Southeasterly from the comer formed by the intersection of the Southerly side of Tarpon Drive and the Easterly side of Main Road (State Route 25); RUNNING THENCE along the Southerly side of Tarpon Drive South 63 degrees 52 minutes 30 seconds East 115.00 feet; RUNN1NG THENCE South 26 degrees 07 minutes 30 seconds West 175.00 feet to a proposed canal; RUNNING THENCE along said proposed canal North 63 degrees 52 minutes 30 seconds West 115.00 feet; RUNNING THENCE North 26 degrees 07 minutes 30 seconds East 175.00 feet to the Southerly side of Tarpon Drive and the point or place of BEGINNING. TOGETHER with the right, title and interest of the parties of the first part of, in and to the land under waters of Peconie Bay adjoining said premises on the South and to the Highway adjoining said premises on the North, to the center line thereof. TOGETHER with the parties of the first part's right, title and interest to the land under water of the basin which ties within the above described property, subject only to the rights of ingress and egress over surface of water by previous grantees of parties of the first part. TOGETHER with the tight of the parties of the second part, their heirs and assigns, to use and maintain at their own expense, the existing inlet from Peconic Bay to the basin adjoining the premises on the East. Said inlet to be no more than fifty (50) feet in width unless parties of the first part, their heirs and assigns, approve in writing. This tight is intended to be the same heretofore granted to Fred W. Young and others and shall be in common with parties of the first part, their heirs and assigns. In the event the present inlet is relocated by grantors, grantees or Fred W. Young; then present inlet shall be closed and all common rights above stated as to ingress, egress and tight to maintain shall apply to said relocate, inlet. SUBJECT to the following: (1) Zoning regulations and ordinances of the Town of Southold; (2) Any state of facts an accurate survey might show. (3) Covenants, easements and resttictions of record, if any. TOGETHER with the tight to use, in common with others, Lot #52, as shown on the filed map for the purpose of bathing and beach activity and the tight to use, in common with others, the boat basin for the purpose of mooting and anchorage of pleasure boats therein. The party of the first part takes no representation that they will develop the boat basin or mooting beyond their present state. TOGETHER with the use of the canal adjacent to Lot #40, and together with an easement and right of way for boating purposes, in common with others, along said canal, being approximately 50 feet in width and running from Lot #40 to the boat basin.
