THIS INDENTURE, made the ~*'~' day~ of April, in the year Two Thousand Three BETWEEN CARLISLE E. COCHRAN, residing al 270 Boisseau Avenue, Southold, New York party of the first part, and CARLISLE E. COCHRAN, JR., residing at (No#) Maple Road, Southold, New York; and ROBERT C. COCHRAN, residing nl (No#) Garden Court, Southold, New York party of the second part, WITNESSETH, that the party of the first pm't, in consideration ofTen Dollars and other valuable consideration paid by the party of the second part, does hereby grunt and release unto the party ofthe second part, the heirs or successors and assigns of the party of the second pan forever, ALL THAT CERTAIN plot, pieee or parcel of land, situate, lying and being at Southold, in the Town of Southold, County of Suffolk and State of New York, bounded and described as follows:- BEGINNING at a point on the easterly line of Boisseau Avenue, which point is South 16 degrees 41 minutes East a distance of 85 feet from the southwesterly corner of premises herelofore conveyed to Carlisle E. Cochran and Jean W. Cochran, his wife, in Liber 3270 cp 230, and which point is the southwesterly corner of the premises herein described; RUNNING THENCE along the easterly line of Boissean Avenue North 16 degrees 41 minutes West a distance of 85 feet to said land of Carlisle E. Cochran and wife; RUNNING THENCE along said land North 70 degrees 31 minutes 40 seconds East a distance of 210 feet more or less to land now or formerly of Komskis: RUNNING THENCE in a southwesterly direction along said land of Komskis a distance of 29 feet more or less to a monument; RUNNING THENCE in a southeasterly direction, still along said land of Komskis, a distance of 77 feet more or less to a monument; RUNNING THENCE in a westerly direction along other land of Edith T. Ceehran a distance of 225 feet to thc point or place of BEGINNING. BEING AND INTENDED TO BE thc same premises conveyed to the party of the first part by deed from Edith T. Cochran dated October 10, 1958, and recorded in the Suffolk County Clerk's Office on February 19, 1968, in Libor 6306 page 101. RESERVING,, HOWEVER, a legal life estate in the above-~escribed premises with the buildings and improvements thereon erected, in and to the party of the first part. THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF APPOINTMENT, exercisable as often as he may choose, to change his remainderman as follows: TO or among any one or more members of a class consisting of the party of the first part's descendants, in any dngree, whether presently living or born hereafter, in such proportions and amounts, without regard to equality, outright or in trust, as the party of the first part may direct and appoint during his lifedme by a properly written and acknowledged insu'ument, and recorded prior to death, making specific reference to this power of appointment. The party of the first part may not appoint himself, his estate, his creditors or the creditors of his estate, under any ci~x~mstances. TOGETHER with all right, title and interest, if any, of thc party of the first part in and to any streets and roads nbutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns ofthe party ofthe second part forever. AND thc party ofthe first part covenants that the party ofthc first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, exccpt as aforesaid. AND the party of the first part, in compliance with Section 13 oftbe Lieo Law, covcnants that the party of the first part will receive the consideration for this convcyancc and will hold thc right to receive such consideration as a trust fund to be applied first for thc purpose of paying the cost of the improvement and will apply the same first to the paymcnt of thc cost of the improvement before using any part oftbe total of the same for any other purposo.
